第二十二条全民所有的博物馆、图书馆和其他单位对收藏的文物，必须区分文物等级，设置藏品档案，建立严格的管理制度，并向文化行政管理部门登记。
Article22Museums,librariesandotherinstitutionsunderownershipbythewholepeoplemustclassifytheculturalrelicsintheircollectionbydifferentgrades,compilefilesfortherelicskeptbythem,establishastrictsystemofcontrolandregistertherelicswiththerelevantdepartmentforculturaladministration.
地方各级文化行政管理部门，应分别建立本行政区域内的馆藏文物档案；国家文化行政管理部门应建立国家一级文物藏品档案。
Localdepartmentsforculturaladministrationatvariouslevelsshallcompilefilesfortheculturalrelicsinthecollectionofculturalinstitutionsintheirrespectiveadministrativeareas;thestatedepartmentforculturaladministrationshallcompilefilesforGradeOneculturalrelicsofthestate.
第二十三条全民所有的博物馆、图书馆和其他单位的文物藏品禁止出卖。这些单位进行文物藏品的调拨、交换，必须报文化行政管理部门备案；

一级文物藏品的调拨、交换，须经国家文化行政管理部门批准。未经批准，任何单位或者个人不得调取文物。

第五章私人收藏文物
CHAPTERVCULTURALRELICSINPRIVATECOLLECTIONS
第二十四条私人收藏的文物可以由文化行政管理部门指定的单位收购，其他任何单位或者个人不得经营文物收购业务。
Article24Culturalrelicsinprivatecollectionsmaybepurchasedbyunitsdesignatedbythedepartmentsforculturaladministration;nootherunitorindividualmayengageinthebusinessofpurchasingculturalrelics.
第二十五条私人收藏的文物，严禁倒卖牟利，严禁私自卖给外国人。
Article25Theresaleofculturalrelicsinprivatecollectionsataprofitshallbestrictlyforbidden,andsoshallbetheprivatesaleofsuchrelicstoforeigners.
第二十六条银行、冶炼厂、造纸厂以及废旧物资回收部门，应与文化行政管理部门共同负责拣选出掺杂在金银器和废旧物资中的文物，除供银行研究所必需的历史货币可以由银行留用外，其余移交给文化行政管理部门处理。移交的文物须合理作价。
Article26Banks,smelteries,papermillsanddepartmentsfortherecoveryofoldandwastematerialsshallassumeresponsibility,jointlywiththedepartmentsforculturaladministration,forsortingoutculturalrelicsfromamonggoldandsilverarticlesandwastematerials.Theculturalrelicsthusobtained,exceptforcoinsandotherkindsofcurrencyofpastageswhichareneededbyresearchinstitutesofthebanksandwhichmaybekeptbythebanks,shallbeturnedovertoandplacedatthedisposalofthedepartmentsforculturaladministration.Thepricesoftheculturalrelicsturnedovershallbereasonablyassessed.
公安、海关、工商行政管理部门依法没收的重要文物，应当移交给文化行政管理部门。
Importantculturalrelicsconfiscatedaccordingtolawbypublicsecurityorgans,theCustomsandthedepartmentsfortheadministrationofindustryandcommerceshallbeturnedovertothedepartmentsforculturaladministration.
第六章文物出境
CHAPTERVITAKINGCULTURALRELICSOUTOFCHINA
第二十七条文物出口和个人携带文物出境，都必须事先向海关申报，经国家文化行政管理部门指定的省、自治区、直辖市文行政管理部门进行鉴定，并发给许可出口凭证。
Article27CulturalrelicstobeexportedortobetakenoutofthecountrybyindividualsmustbedeclaredtotheCustomsinadvanceandexaminedbythedepartmentforculturaladministrationofaprovince,anautonomousregionoramunicipalitydirectlyundertheCentralGovernmentdesignatedbythestatedepartmentforculturaladministrationbeforeexportcertificatesaregranted.
文物出境必须从指定口岸运出。经鉴定不能出境的文物，国家可以征购。
Culturalrelicsleavingthecountrymustbeshippedoutatdesignatedports.Culturalrelicswhich,afterexamination,arenotpermittedtoleavethecountrymayberequisitionedbythestatethroughpurchase.
第二十八条具有重要历史、艺术、科学价值的文物，除经国务院批准运往国外展览的以外，一律禁止出境。
Article28Itshallbeprohibitedtotakeoutofthecountryanyculturalrelicsofsignificanthistorical,artisticorscientificvalue,withtheexceptionofthosetobeshippedabroadforexhibitionwiththeapprovaloftheStateCouncil.
第七章奖励与惩罚
CHAPTERVIIAWARDSANDPENALTIES
第二十九条有下列事迹的单位或者个人，由国家给予适当的精神鼓励或者物质奖励：
Article29Thestateshallgiveappropriatemoralencouragementormaterialawardstounitsorpersonsforanyofthefollowingdeeds:
（一）认真执行文物政策法令，保护文物成绩显著的；
(1)seriousimplementationofthepolicies,lawsandregulationsconcerningculturalrelicsandremarkableachievementsinprotectingculturalrelics;
（二）为保护文物与违法犯罪行为作坚决斗争的；
(2)resolutestruggleagainstcriminalacts,intheinterestofprotectingculturalrelics;
（三）将个人收藏的重要文物捐献给国家的；
(3)donationofimportantculturalrelicsinone'sowncollectiontothestate;
（四）发现文物及时上报或者上交，使文物得到保护的；
(4)timelycommunicationofinformationon,ordeliveryof,theculturalrelicsdiscovered,whichfacilitatestheirprotection;
（五）在文物保护科学技术上有重要发明创造或者其他重要贡献的；
(5)importantinventionsandinnovationsin,orothermajorcontributionsto,thescienceandtechniquesfortheprotectionofculturalrelics;
（六）在文物面临破坏危险的时候，抢救文物有功的；
(6)meritoriousserviceinrescuingculturalrelicsindangerofbeingdestroyed;and
（七）长期从事文物工作有显著成绩的。
(7)long-timeserviceandoutstandingachievementsinthefieldofculturalrelics.
第三十条有下列行为的，给予行政外罚：
Article30Administrativesanctionsshallbeappliedtothosewhohavecommittedanyofthefollowingacts:
（一）在地下、内水、领海及其他场所中发现文物隐匿不报，不上交国家的，由公安部门给予警告或者罚款，并追缴其非法所得的文物；
(1)hidingculturalrelicsdiscoveredunderground,ininlandwaters,interritorialseasorinotherplacesandfailingtoreportanddeliverthemtothestate,forwhichthepersonsinvolvedshallbewarnedorfinedbyapublicsecuritydepartmentandtheculturalrelicsillegallyacquiredbythemshallberecovered;
（二）未经文化行政管理部门批准，私自经营文物购销活动的，由工商行政管理部门给予警告或者罚款，并可没收其非法所得或者非法经营的文物；
(2)buyingorsellingculturalrelicswithouttheapprovalofthedepartmentsforculturaladministration,forwhichthepersonsinvolvedshallbewarnedorfinedbythedepartmentsfortheadministrationofindustryandcommerce,andtheirillegalearningsandtheculturalrelicsillegallyhandledbythemmaybeconfiscated;or
（三）将私人收藏的文物私自卖给外国人的，由工商行政管理部门罚款，并可没收其文物和非法所得。
(3)sellingculturalrelicsinprivatecollectionstoforeignerswithoutpermission,forwhichthepersonsinvolvedshallbefinedbythedepartmentsfortheadministrationofindustryandcommerce,andtheculturalrelicsinquestionandtheillegalearningsderivedtherefrommaybeconfiscated.
第三十一条有下列行为的，依法追究刑事责任：
Article31Personswhocommitanyofthefollowingactsshallbeinvestigatedforcriminalresponsibilityaccordingtolaw:
（一）贪污或者盗窃国家文物的；
(1)misappropriatingorstealingculturalrelicsofthestate;
（二）盗运珍贵文物出口或者进行文物投机倒把活动情节严重的；
(2)seriouscasesofsmugglingvaluableculturalrelicsoutofthecountryorspeculatinginculturalrelics;
（三）故意破坏国家保护的珍贵文物或者名胜古迹的；
(3)wilfuldamageofvaluableculturalrelicsorplacesofculturalandhistoricalinterestunderstateprotection;and
（四）国家工作人员玩忽职守，造成珍贵文物损毁或者流失，情节严重的。
(4)seriousdamageof,orseriouslossestovaluableculturalrelicscausedbythederelictionofdutyonthepartofstatepersonnel.
私自挖掘古文化遗址、古墓葬的，以盗窃论处。
Thosewhoexcavatesitesofancientcultureorancienttombswithoutpermissionarepunishableforlarceny.
将私人收藏的珍贵文物私自卖给外国人的，以盗运珍贵文物出口论处。
Thosewhosellvaluableculturalrelicsinprivatecollectionstoforeignerswithoutpermissionarepunishableforsmugglingvaluableculturalrelicsoutofthecountry.
文物工作人员对所管理的文物监守自盗的，依法从重处罚。
Personnelworkinginthefieldofculturalrelicswhostealculturalrelicsplacedundertheircareshallbepunishedseverelyaccordingtolaw.
第八章附则
CHAPTERVIIISUPPLEMENTARYPROVISIONS
第三十二条国家文化行政管理部门根据本法制定实施细则，报国务院批准施行。
Article32Thestatedepartmentforculturaladministrationshall,inaccordancewiththisLaw,formulaterulesforitsimplementation,whichshallcomeintoforceafterbeingsubmittedtoandapprovedbytheStateCouncil.
文物的复制、拓印、拍摄等管理办法由国家文化行政管理部门制定。
Measuresgoverningtheproductionofreplicas,rubbingsandphotographsofculturalrelicsshallbeformulatedbythestatedepartmentforculturaladministration.
第三十三条本法自公布之日起施行。一九六一年国务院颁发的《文物保护管理暂行条例》即行废止。其他有关文物保护管理的规定，凡与本法相抵触的，以本法为准。
