ThisdocumentistheGeneralConditionsofCarriageforPassengerandBaggage(hereinafterreferredtoas‘theConditions’or‘theseConditions’)setbyChinaSouthernAirlines(hereinafterreferredtoas‘CSN’)aspartofthepassengercarriagecontract,whilethetermslistedintheseConditionsaimatclarifyingrightsandobligationsbetweenthecarrierandpassengers.
1.2BasisofFormulation
TheseConditionsaredevelopedinaccordancewiththeCivilAviationLawofthePeople'sRepublicofChina,LawofthePeople'sRepublicofChinaontheProtectionofConsumerRightsandInterests,E-CommerceLawofthePeople'sRepublicofChina,theRegulationontheManagementofPublicAirTransportationforPassengers,theLarge-scalePublicAirTransportCarrierCertificationRulesofOperation(theCCAR-121),theOperationofCivilAircraftAirworthinessRegulations(theCCAR-121AA),theRegulationontheTransportofDangerousGoodsbyAirandotherlawsandadministrativeregulations.
1.3OverridingLaw
Theestablishment,validity,interpretation,performance,disputeresolutionandothercontractualissuesshallbegovernedbythelawsofthePeople'sRepublicofChinaaswellastheinternationalconventionsconcludedoraccededtobythePeople'sRepublicofChina.
IfanyprovisionoftheseConditionsofCarriageisinconflictwithinternationalconventions,applicablelawsandthusisdeemedinvalidbyjudicialorarbitrationbodies,theotherprovisionsoftheseConditionsofCarriageshallremainvalid.
1.4SupplementaryRule
WheretheitemslistedintheseConditionschangemorefrequently,CSNmayformulateseparateprovisionsandconsiderthempartoftheseConditions.IfaseparatelyformulatedprovisionisinconsistentwiththecontentsoftheseConditions,theseparatelyformulatedprovisionshallprevailovertheseConditions.
1.5LanguageVersion
TheseconditionsarewritteninChineseandtranslatedintootherlanguages.IncaseofanyinconsistencybetweentheChineseversionandtheotherlanguageversions,theChineseversionshallprevail.
2.1GeneralRules
2.1.1ExceptasprovidedinProvision2.2and2.3ofthisArticle,theseConditionsofCarriageapplytoairtransportationoperatedbyCSNforthepurposeoftransportingpassengersandbaggagebycivilaircraftandchargingfees.TheseConditionsofCarriageformpartofthecontractbetweenusandthepassenger,andtherights,obligationsandresponsibilitiesofbothpartiesareboundbytheseConditionsofCarriage.
2.1.2TheseConditionsofCarriagealsoapplytocarriageonspecialticketssuchasfreetickets,promotionalfareandspecialfaretickets.Wherediscrepanciesexistbetweentheconditionsofuseoffreetickets,promotionalfareandspecialfareticketsandtheseConditionsofCarriage,theconditionsofuseofsuchticketsshallprevail.
2.2Charters
Forthetransportationperformedpursuanttoacharteragreement,theseConditionsofCarriageapplyonlytotheextenttheyareincorporatedbyreferenceintheprovisionsofthecharteragreementorintheconditionsofuseofthecharterflightticket.
2.3CodeShares
CSN'sConditionsofCarriagealsoapplytocodeshareflightswithCSNoperatedbyothercarriers.However,eachoperatingcarrierofacodeshareflighthasitsownConditionsofCarriageortransportationregulationswithrespecttotheoperationofitsownflights,andsomemaydifferfromCSN'sConditionsofCarriageforflightsoperatedbyCSN.ExceptasprovidedinArticles3,8and9,thesedifferentrulesandConditionsofCarriageestablishedbytheoperatingcarrierwillbeconsideredaspartsofCSN'sConditionsofCarriageoncodeshareflights,andwilltakeprecedenceoverCSN'sConditionsofCarriageonthesecodeshareflights.TermsandconditionsthatdifferbetweenCSNanditscodesharepartnersmayinclude,butarenotlimitedto:
a)Check-inpolicies;
b)Refusalofandlimitationoncarriage;
c)Baggageregulation;
d)Oversales;
e)Flightdelayandcancellation.
3.1GeneralRules
3.1.1General
3.1.1.1Theticketevidencesapartofthecontractofcarriagebetweenthecarrierandthepassengerwhosenameisshownontheticket.ThecarriageserviceisonlyprovidedtothepassengerwhoholdsaticketissuedbyCSNorbycarriersthathavesignedinterlineagreementwithCSN.
3.1.1.2PassengerswhopurchaseasingleticketwithconnectingflightshallenterintoasinglecontractofcarriagewithCSN.PassengerswhopurchasemultipleticketsshallenterintomultipleindependentcontractsofcarriagewithCSN.Unlessotherwisespecified,agreedrightsandobligationsbetweenCSNandthepassengerasstipulatedintheseConditionsshallonlyapplytoasinglecontractofcarriageandshallnotbeimplicatedinothercontractsofcarriage.AccordingtorelevantlawsandregulationsandtheprovisionsoftheseConditions,thepurchaseofmultipleticketsorthepurchaseofasingleticketwithconnectingflight,shallleadtodifferentlegaleffects.Passengersshallfullyunderstandthisandpurchaseticketsaccordingtotheirownairtravelsituation.
3.1.1.3Eachpassengershallindividuallyholdhisownticket.
3.1.1.4Ticketscannotbetransferred.
3.1.1.5Ontheticket,thenameofChinaSouthernAirlinesisshortenedto‘CZ’,theairlinetwo-charactercode.WhenCSNisthevalidatingcarrier,thefirstthreedigitsoftheticketnumberareindicatedas‘784’,whichisCSN’ssettlementcode.
3.1.2ValidityPeriod
3.1.2.1Thepassengershallcompletetheentireitineraryspecifiedontheticketwithinthevalidityperiod.
3.1.2.2UnlessotherwiseUnlessotherwisespecified,aticketisvalidfor:
a)Ifportionoftheticketisused,oneyearfromthefollowingdayafterthedateofcommencementoftravel.Regardlessofreroutingorticketexchangeafterwards,theoriginalperiodofvalidityremainsunchanged.
b)Ifnoportionoftheticketisused:
1)Oneyearfromtheticketissuance,countingfromthemidnightofthefollowingdayafterthedateofticketissuance.
2)Oneyearfromthefollowingdayafterthedateofexchange,ifthepassengersapplyforairticketreissuanceandreceiveanewticketnumber.
3.1.2.3Thecalculationofticketvaliditystartsfrom00:00(included)ofthefollowingdayafterthecommencementofthefirsttravel,ticketpurchaseorticketreissuanceto24:00(excluded)onthedayofexpirationofthevalidityperiod.
3.1.2.4Certaindiscountfaresimposestrictrestrictionsontheminimumand/ormaximumlengthofstayinoneplace,andthepassengermustcompletethetripwithinaspecifiedtimelimit.
3.1.3Sequenceanduseofticketcoupons
3.1.3.1Generalrules
a)Theticketpurchasedisvalidonlyforthetransportationshownontheticket,fromtheplaceofdepartureviaanyagreedtransitionpointtothefinalplaceofdestination.
b)Eachflightcouponcontainedinaticketwillbeacceptedfortransportationintheclassofserviceonthedateandflightforwhichspacehasbeenreserved,asshownontheflightcoupon.
3.1.3.2Validityoftickets
a)Thefarepaidbythepassengerisrelatedtotheorderofcarriagespecifiedontheticket.Unlessotherwisespecifiedintheconditionsofuseoftheticket,theflightcouponsoftheticketshallnotbeusedinreverse.
b)Thefirstsegmentofthetripmustbeusedfirst.Thefirstsegmentofthetripmeansthefirstlegofthetriplistedononesingleticketormultipleconsecutivetickets.
c)Ifthepassengerdoesnotusetheticketintheprescribedorder,heorshemayvoluntarilychangetheroutingiftheconditionsfortheuseoftheticketpermit,andcontinuetotravelonthenewroutingorvoluntarilyrefundtheticket.
d)Inthecaseofinvoluntaryflightcancellation,delay,earlydeparture,rerouting,changeincabinclass,orinabilityofacarriertooperatetheoriginalflight,thepassengerwhocannotusetheticketintheordershallnotbesubjecttothisrestriction,butmaynotusetheticketinreverseorder.
3.1.3.3OpenTicket
IfapassengerholdsanOpenTicket,theseatcanbereservedinaccordancewiththefareregulationsandseatavailabilityofspaceontheflightappliedfor.Totheextentpermittedbytheconditionsofuseofsuchticketsandthecontractofcarriage,beforetheactualcarriage,thepassenger'sfirstconfirmationofthemattersnotsettledontheticketcanbeexemptedfromthechangefee,andonlythedifferencebetweenthefareofthenewticketandtheopenticketatthetimeofbookingiscollected.Changesafterthefirstconfirmation,orchangestothealreadyconfirmedinformationontheoriginalticketshallbecarriedoutinaccordancewiththeconditionsofuseoftheticket.
3.1.3.4IfapassengerfailstotakeaflightwithareservedseatanddoesnotnotifyCSNinadvance,CSNreservestherighttocancelthesubsequentconnectingflightreservationspecifiedonthepassenger'sticket.
3.1.4Fares,Taxes,FeesandCharges
3.1.4.1Fares
Thefares,taxes,feesandchargesfortheflightsineffectonpassenger’spurchasedareapplicableforthedateofflight,routing,andotherinformationspecifiedontheflightcoupons.Aftertheticketissold,ifthefaresareadjusted,theabove-mentionedamountsalreadypaidremainunchanged.Changestothespecificsoftheitinerary,includingtheflightdate,flight,etc.mayaffecttheaboveamountsalreadypaid.
a)Unlessotherwiseprovidedfor,faresareonlyapplicabletoairtransportationfromtheairportofdeparturetotheairportofdestination,excludinggroundtransportationbetweenoneairporttoanotherairportinthesamecityorthegroundtransportationbetweentheairportanddowntown.
b)Someticketsmayapplytoconditionscontainrestrictionsonchangeand/orrefundclauses.Passenger(s)shouldpurchaseticket(s)withthefarethatbestsuitstotheirownairtravelsituations.
3.1.4.2Taxes,FeesandCharges
a)Taxes,feesorchargesimposedbytheGovernmentorotherrelevantauthoritiesorairportoperatorsinconnectionwiththeprovisionofservicestopassengersarenotincludedintheapplicablefares.Suchtaxorfeeshallbepaidbythepassengerandcollectedonbehalfoftheairline.
b)Fuelsurcharges,aviationinsurancesurchargesandsalesrelatedfeesareissuedandcollectedbyairlinesinaccordancewithrelevantregulationsorpoliciesofdifferentcountriesandauthorities.
c)Fares,taxes,feesandchargesshallbepaidinthecurrencyandpaymentmethodprescribedbythenation,unlessotherwiseagreedbetweenCSNandthePassenger.
d)Uponpurchasingaticket,passenger(s)willbeadvisedoftaxes,feesandchargesnotincludedinthefare,mostofwhichwillnormallybeshownseparatelyontheticket.Thetaxes,feesandchargesimposedonairtravelareconstantlychangingandcanbeimposedafterthedateofticketissuance.Ifthereisanincreaseintheapplicabletax,feeorchargeshownontheticket,passenger(s)willbeobligedtopayit.Likewise,ifanewtax,feeorchargeisimposedafterticketissuance,passengerwillbeobligedtopayit.Intheeventanytaxes,feesorchargeswhichpassengerhaspaidtoCSNatthetimeofticketissuanceareeliminatedorreduced,suchthattheynolongerapply,oralesseramountisdue,passenger(s)maybeentitledtoarefundofanysuchtaxes,feesorchargesashavebeeneliminatedorreduced.CSNwillrefundaccordingtotherulebygovernment.
3.1.5Itinerary/ReceiptofE-TicketforAirTransportation
Theitinerary/receiptofE-TicketforAirTransportationisoneoftheinvoicesforcivilaviationelectronicticket.Paperitinerary/receiptofE-TicketforAirTransportationcanbeprintedrightafterthesale,andshallbeprintedwithin26daysafterthecompletionoftheitineraryintheoriginalticketpurchasechannel.Passenger(s)shouldkeeptheirprinteditineraryproperly.Ifarefundisrequired,theprinteditinerary/receiptshouldbeprovided.Electronicitinerary/receiptofE-TicketforAirTransportationcanbeissuedonlyaftertheentireitineraryisfinished.
3.2ReservationsandTicketing
3.2.1GeneralRules
3.2.1.1Passenger(s)canaskforinformation,reserveseatsandpurchaseticketsthroughCSN’sofficialwebsite,mobileapplications,servicehotline,salesoffice,salesagencies,andotherchannelsthatapprovedbyCSN.
3.2.1.2Reservationsandfareamountwillnotbevaliduntilthetotalfares,taxes,feesandchargeshavebeenpaidinaccordancewiththeproceduresandtimelimitssetforthbyCSN.
3.2.1.3CSNreservestherightnottosellticketsandrefusetocarryanyindividualwhoisunfittotravelbyair.Passenger(s)underrestrictedcarriagemayreserveseatsandpurchaseticketsonlyafterallcertainrequirementsaremetandtheconsentofallcarriersinvolvedarereached
3.2.1.4Forpassengerswhomaliciouslyoccupyseatsorfalselypurchasetickets,CSNreservestherighttorestricttheirseatreservationsandticketpurchases.
3.2.2PersonalInformation
3.2.2.1Whenpurchasingtickets,passenger(s)shouldprovidevalididentitydocumentinformationofhis/herownorothervalididentitydocumentsissuedbylegalstatedepartments,alongwithaccurateandvalidcontactinformation.Meanwhile,passenger(s)mustensuredocumentsusedtopurchaseticketsarethesameasthoseusedforcheck-inandboarding.Ifpassenger(s)refusetoprovidenecessarypersonaldata,CSNmayrefuseforseatreservationandticketpurchase.
3.2.2.2Passenger(s)shallrecognizethattheirpersonaldatagiventoCSNisforthepurposeofmakingareservationandotherrelatedservicesforcarriage.Forthesepurposes,passenger(s)authorizeCSNtoretainsuchdataandtotransmitittoCSN’sownoffices,othercarriers,providersofrelevantservicesaswellasinstitutionsapprovedbylawsandregulations.CSNwilltakeallreasonableandfeasiblesecuritycontrolmeasurestoprotectpassengers’personalinformation.Passenger(s)caninquireCSNaboutCSN’sprivacypolicy.TheprivacypolicyisnotpartoftheseConditionsofCarriage.
3.2.2.3Passenger(s)shallbeliablefortheauthenticityandvalidityoftheirpersonaldata.CSNhasnoobligationfortheverification.
3.3SeatAllocation
3.3.1CSNshallmakereasonableeffortstomeetadvancedseatallocationrequests.However,CSNcannotguaranteetheprovisionofanyparticularseatintheaircraftandisonlyresponsibleforprovidingseatsaccordingtopassenger’sclassofserviceshownontheticket.Thecarrierreservestherighttochangetheseatallocationatanytime,includingafterboarding,duetooperating,securityorsafetyimperatives,orforreasonsofforcemajeure.
3.3.2Seatsneartheaircraft’semergencyexitsshallbespecificallyarrangedbyCSN,andpassengersseatedneartheemergencyexit(orontheemergencyexitrowofseats)musthavetheabilitytocompletetheemergencyevacuationprocedures.
4.1Check-in
4.1.1Passenger(s)shallhavethepurchasedticketinspected,baggagechecked,andpaperorelectronicboardingpassobtainedwithvalidtraveldocumentswhichcarryrealnamebeforethecheck-indeadline.ThevalidIDpresentedshouldbethesameastheoneprovidedatthetimeofticketpurchase.CSNwillmakeaphotocopyoftheabove-mentionedtraveldocumentswhennecessary.
4.1.2Thecheck-indeadlinesvaryfromoneairporttoanother.Passenger(s)shallarriveattheairportsufficientlyinadvanceofflightdeparturetoavoidmissingtheflight.
4.1.3MissingFlights
Ifpassenger(s)missaflightforreasonsnotattributabletoCSN,CSNwillcancelthespacereservedforthepassenger(s).CSNisnotliableforanylossorexpenseincurredbythepassenger(s)asaresult.Ifpassenger(s)requestforchangeorrefund,theticketwillbeprocessedinaccordancewiththerulesofvoluntarychangeorvoluntaryrefund;meanwhilethepassenger(s)mayberequiredtopayno-showcharge.Ifpassenger(s)missaflightforreasonsattributabletoCSN,theticketwillbeprocessedinaccordancewiththerulesofinvoluntarychangeorinvoluntaryrefund.
4.2TravelDocumentationsandSecurityInspection
4.2.1TravelDocumentations
4.2.1.1Passenger(s)areresponsibleforobtainingthetraveldocuments,visasorcertificatesrequiredbyhealthandepidemicpreventionpoliciesasrequiredbytheplaceofdepartureandtheagreedtransitionpoint(s)andthedestination.Passenger(s)shallunderstandandabidebyalltheirapplicablelaws,regulations,decreesandtravelregulations.Ifpassenger(s)failtocomplywiththerelevantregulationsandareunabletotaketheflightorarriveattheirdestinations,CSNshallnotbeliableforanylossesincurredasaresult.
4.2.1.2CSNandCSN’sauthorizedagentsprovidepassenger(s)withtheinformationrequiredinprovisions4.2.1.1onlyforthepurposeofprovidingpassenger(s)withconvenienceandassistance.CSNisnotresponsiblefortheaccuracyofthisinformationandtheconsequencesarisingfrompassenger(s)failuretoobtaintheabovedocumentsorvisas,orfailuretocomplywiththeabove-mentionedlaws,regulations,decreesandtravelregulations.
4.2.1.3Passenger(s)shallpresentallexits,entry,healthandothernecessarydocumentsrequiredbylaws,regulations,orders,demandsortravelrequirementsofthecountriesconcerned,andpermitCSNtotakeandretaincopiesthereof.CSNreservestherighttorefusecarriageofanypassengerwhodoesnotcomplywithapplicablelaws,regulations,orders,demandsortravelrequirementsorwhosedocumentsfailtocomplywithrelevantrequirements,orwhodoesnotpermitCSNtotakeandretaincopiesthereof.
4.2.1.4Passenger(s)agreestopaytheapplicablefarewheneverCSN,onGovernmentorder,isrequiredtoreturnapassengertohis/herpointoforiginorelsewhere,owingtothepassenger(s)inadmissibilityintoacountry,whetheroftransitorofdestination.CSNmayapplytothepaymentofsuchfareanyfundspaidtoCSNforunusedcarriage,oranyfundsofthepassengerinthepossessionofCSN.ThefarecollectedforcarriagetothepointofrefusalofentryordeportationwillnotberefundedbyCSN.
4.2.1.5IfCSNisrequiredtopayordepositanyfineorpenaltyortoincuranyexpenditurebyreasonofthepassenger(s)failuretocomplywithlaws,regulations,orders,demandsandtravelrequirementsofthecountriesconcernedortoproducetherequireddocuments,thepassenger(s)shallondemandreimbursetoCSNanyamountsopaidordepositedandanyexpendituresoincurred.CSNmayusetowardssuchexpenditureanyfundspaidtoCSNforunusedcarriage,oranyfundsofthepassenger(s)inthepossessionofCSN.
4.2.2SecurityInspection
Passenger(s)andthebaggageshallundergosafetyandsecurityinspections.Theinspectionscanbecarriedoutinwaysthatincludebutarenotlimitedtotheuseofequipment,useofmanpower,oralinquiryandothersprescribedbythelocalgovernmentorsecuritycheckauthorities.Themethodsofinspectionusedaredeterminedbythegovernment,theairportsoroursolediscretion,regardlessofwhetherthepassenger(s)arepresent,agreeorareinformed.CSNshallnotbeliableforanyphysicalinjuryanddamagetoorlossofbaggageattributabletosuchinspections,unlesssuchinjury,damageorlossarisesfromourwillfulconductorgrosserrors,exceptasotherwiseprovidedbyChina'slawsandinternationalconventions.
4.3Boarding
4.3.1Theclosingtimesofboardinggatesdifferaccordingtoflights.Passenger(s)shallproceedaccordingtotheclosingtimeoftheboardinggatesateachairporttoavoidmissingtheflight.
4.3.2FailtoBoardaFlight
IfapassengerfailstoboardaflightforreasonsnotattributabletoCSN,CSNshallnotbeliableforanylossorexpenseincurredbythepassenger.Ifthepassengerrequestsachangeorrefund,avoluntarychangeorrefundshallbemadeinaccordancewithprovisions8.2or9.2oftheseConditions.Meanwhilethepassengermayberequiredtopayno-showcharge.IfapassengerfailstoboardaflightduetoreasonsattributabletoCSN,aninvoluntarychangeorrefundshallbemadeinaccordancewithprovisions8.3or9.3oftheseConditions.
4.3.3BoardaWrongFlight
Ifapassengerboardsawrongflightandarrivedatadestinationnotshownontheticket,CSNwillprovidefollowingalternativestotheextenttheyareavailable:
a)Ifthereisasubsequentflightfromtheairportthatthepassengerhaveflowntoonthewrongflighttothedestinationshownontheticket,CSNwillmake,forfree,arrangementsforthepassengertoflydirectlyfromtheairportthatthepassengerhaveflowntoonthewrongflighttothedestinationshownontheticket.ThefarehaspaidwillnotberefundednordothepassengerneedtomakeanypaymenttoCSN.
b)CSNwilltransportthepassengerbacktothedepartureairportwhereCSNwillputthepassengeronaflighttothedestinationshownonthepassenger’sticketassoonaspossible.ThefarehaspaidwillnotberefundednordothepassengerneedtomakeanypaymenttoCSN.
c)CSNwillgrantarefundoftheoriginalflightsegmentoftheticketshouldthepassengerrequestterminationofthetravelattheairportthatthepassengerhasflowntoonthewrongflight.
4.3.4CSNorCSN'sauthorizedgroundserviceagentwillinformpassengersinatimelymannerofanychangestotheboardinggateorboardingtime.
4.4JourneyAbortion
Incasethatapassengerrequeststoabortthejourneyforpersonalreasonsafterthecabindoorhasbeenclosed,thecaptainisentitledtorefusethepassenger'srequestwhenthecaptainassessesthatsuchbehaviormaycauseadelayorafurtherdelayoftheflightandconflictwiththeinterestsofotherpassengersonboard,exceptforcertainforcemajeureortheeventofasuddenemergencyoflife-threateningillnessofthepassenger.Passenger(s)whowouldnotcooperateanddisrupttheorderonboardasaresultshallbearthecorrespondinglegalconsequences.
4.5ConductDuringAirTravel
4.5.1GeneralRules
Ifpassenger(s)conductshimself/herselfaboardtheaircraftsoastoendangertheaircraftoranypersonorpropertyonboard,orobstructsthecrewintheperformanceoftheirduties,orfailstocomplywithanyinstructionofthecrew,orbehavesinamannertowhichotherpassengersmayreasonablyobject,CSNreservestherighttotakesuchmeasuresasitdeemsnecessarytopreventcontinuationofsuchconduct,includingrestraintofthepassenger.Passenger(s)maybedisembarkedandrefusedonwardcarriageatanypointandpassenger(s)maybelegallyprosecutedforoffencecommittedonboardtheaircraft.
4.5.2HandlingoftheUnlawfulInterferenceandDisturbanceBehavior
4.5.2.1UnlawfulInterferencereferstotheactthatendangerscivilaviationsafetyortheactactionsthathasnotbeensuccessfullytakentoendangercivilaviationsafety,includingbutnotlimitedto:
a)Illegallyhijackingaircraft;
b)Damagingaircraftinuse;
c)Detainhostagesonaircraftorinanairport;
d)forciblybreakingintoaircraft,airportsoraviationfacilities;
e)Bringingweaponsordangerousdevicesormaterialsintoaircraftorairportsforcriminalpurposes;
f)Usingaircraftinusetocausedeaths,seriouspersonalinjuries,orseriousdamagetopropertyortheenvironment;
g)Spreadfalsemessagesendangeringthesafetyorpassengers,flightcrew,groundstafforpubliconaircraftinairorontheground,atairportorcivilfacilities.
4.5.2.2Disturbancebehaviorreferstobehaviorthatdisruptstheorderoftheairportorcabinbyfailuretoabidebythecodeofconductattheairportorontheaircraft,orfailuretofollowtheinstructionsoftheairportpersonnelorthecrew,includingbutnotlimitedto:
a)Occupationofanypassengerseatoroverheadstowagebinbyphysicalforces;
b)Engaginginphysicalcombatandprovokingtroubles;
c)Usethemobilephonesorotherprohibitedelectronicdevicesinviolationofregulations;
d)Stealing,willfuldamageorunauthorizedmovementoflife-savingarticlesandotheraviationfacilitiesandequipmentorforcedopeningoftheemergencycabindoor;

4.5.2.3HandlingProcedures
a)Inaccordancewiththenationallawsandcivilaviationrules,iftheUnlawfulInterferenceandDisturbanceBehaviorfindsthattheactionsofpassenger(s)withinthecabincausesaclearviolationofapplicablelaws,CSNshallmakenecessarymeasurestostop,subdueorrestrainthepassenger(s)andrequirethemtoleavetheaircraftbeforetakeofforafterlanding.CSNhavetherighttoclaimfordamagesbasedontheconductofthepartiesinvolved.
b)Forpassenger(s)whodisturbtheorderintheaircraftorcivilaviationtransportation,jeopardizethepersonalandpropertysafetyofpassengersandcrewmembers,endangertheflightsafetyorpublicsafety,donotlistentothecrew'sdissuasionsorwarnings,setoffthesmokealarmsduetosmoking,orimpedetheperformanceoftheirdutiesbythecrewmembers,CSNwillcallthepolicetodealwiththematterwhennecessaryandhanditovertothepublicsecurityauthoritiesorthejudicialauthorities.
4.5.3Inordertomaintaingoodorderonboard,ensureflightsafetyandprotecttheportraitrightsofothers,donottakephotosorvideosofothers(otherpassengers,crewmembers,etc.)withouttheirconsent.
4.5.4ForbiddenUseandRestrictionsonPortableElectronicDevices(PED)
4.5.4.1GeneralRules
a)TheuseofPortableElectricalDevicesthatmeettherequirementsisallowedduringflightsonCSN.
b)Incourseofflight,PEDcellularmobilecommunicationfunctions(voiceanddata)mustbeturnedOFF.ForPEDswithairplanemodefunction,usingWIFIandBluetoothfunctionisallowedbutairplanemodeshallbeactive/turnedON(i.e.,turningoffcellularmobilecommunicationfunction).
c)Duringtheflight,ifelectronicdisruptionhasbeenfoundandthecrewmembersdoubtthatsuchinfluencecomesfromoperatedportableelectronicdeviceonboard,crewmembershavetherighttorequiresuchoccupantstoturnofftheportableelectronicdevices.Casesofgrossviolationshallbereferredtolocalpoliceauthorityorjudicialorgan.
4.5.4.2RequirementsfortheuseofPED
a)Theelectricaldevicesthatallowedtobeusedduringthewholeflight,includebutnotlimitedto:
1)Portabletaperecorder;
2)Hearingaid;
3)Heartpacemaker;
4)Electronicshaver;
5)Life-sustainingelectricalequipment(devices)thatdonotaffecttheaircraft’snavigationandcommunicationsystem.
b)ThePEDdevicesthatareprohibitedforusein-flight,includebutarenotlimitedtothefollowing:
1)Mobilecommunicationdeviceswithoutairplanemode(deviceonlyequippedwithcellularmobilitycommunicationfunction,includebutarenotlimitedtomobilephones,watchesprovidedwithmobilephonefunctions);
2)satellitephone;
3)Walkie-talkie.
4)Remotecontroldevice(remotecontroltoyandotherelectricalequipmentwithremotecontroldevice).
c)Infollowingflightphases,itisforbiddentouseotherportableelectricaldevicethanthoseelectricaldevicesthatareallowedforuseduringflight:
1)Within20minutesafteraircrafttakeoff,andwithin30minutespriortolanding;
2)Flightphaseinlowvisibility.
4.5.4.3TheRequirementsofStorage,Safekeeping,andEmergencyOperationonPED
a)LargePEDdevices(thathavethesumoflength,widthandheightofitscontoursizeabove31cm,suchasportablecomputers,PADs,etc.)shallbesafelystowedsothatnoriskisarisenintheturbulence,impact,oremergencyevacuation.
b)SmallPEDdevices(thesumofthelength,width,andheightofitscontoursizebeloworequalsto31cm,suchase-bookandmobilephone,etc.)isjustsubjecttoappropriatesecuringmethodbythepassenger(s).
c)PEDaccessory(forexample:headsetandrechargewire)shallbesafelystowedduringcriticalflightphases,suchasaircrafttaxiing,takeoff,descending,andlanding,andcannotobstructemergencyevacuationinemergencycondition.
d)TheelectricalpowerofPEDinpersonalbaggageoroverheadcompartmentshallbeturnedoff.
4.5.4.4ProhibitedUseofPowerBanks
Thepowerbanksshouldbeturnedoffintheaircraft.Usingandchargingthepowerbanksisprohibitedintheaircraft.
4.5.5Non-SmokingFlights
AllCSNflightsarenon-smokingflights.Smokingcigarette,electroniccigaretteandsimilarproductisprohibitedinallareasoftheaircraft.
4.5.6RestrictiononAlcoholicDrinks
Whileaboardaircraft,passengersarenotallowedtoconsumeanyalcoholicdrinksotherthanthoseprovidedbyCSN.
4.5.7CompulsoryUseofSeatBelts
4.5.7.1Whenpassengersareseatedontheaircraft,passengershavetheobligationtofastentheirseatbeltduringtheentireflight.
4.5.7.2Aninfantmaybecarriedbyanadultoruseaninfantseatbelt.
5.1RefusalofCarriage
CSNshallretaintherighttorefusetransportonanypassengerforthefollowingconditions:
5.1.1Passengerswhoviolateorfailtocomplywithrelevantlaws,regulationsandsafetyrequirementsofCSN:
a)Passenger(s)whoareinviolationofanyapplicablelaws,regulations,orordersofthecountryorregiontobeflownfrom,through,toorover.
b)Passenger(s)whorefusetosubmittosecuritycheckscarriedoutbygovernments,airportsorCSN.
c)Passenger(s)whorefusetopresentvalidIDormayberepatriatedinthemiddleoftheflightbecausetheconnectingflightisnotbooked
d)PassengerswhohavenotcomplywiththeregulationsofCSNordonotfollowcrewmembers’arrangementandpersuasion.
e)Passenger(s)whorefusetocomplywiththeexit-seatrestrictionsestablishedbycrewmembers,authorizedstaffsorthecarrier.
f)DisabledPassenger(s)whoshallonlybeseatedinexitseat.
g)Passengerswhoarenotinapositiontoprovethattheythepersonreferredtointhe‘PassengerName’boxontheticketsoronthetraveldocument.
h)Passenger(s)whoarequalifiedindividualswithdisabilities,butthenumberofsuchpersonscarriedontheflighthasreacheditsrestrictednumber.
i)Passenger(s)whohavespecialstenchorspecialquirksthatmaycausediscomforttootherpassengers;
j)Passenger(s)whomayendangerthesafetyofanaircraft,orpassengerswithwords,motivesoractionsthatthreatenflightsafety
k)Passenger(s)whoaredrunk,orunabletocontroltheiractions,orlikelytocauseharmtootherpassengersorthemselves,orhaveviolenttendenciestowardsothersandmayaffectthesafetyofothersandproperty.
5.1.2OtherpassengersspecifiedbyCSN:
a)Newbornbabieslessthan14daysofageandprematurebabieslessthan90daysofage(Gestationalageof28weeksandlessthan37weeks),orinfantswithoutanadultaged18yearsorolderaccompanied.
b)Pregnantwomenmorethan36weeks,orpregnantwomenwhoseduedateisnearbuttheexactdatecannotbedetermined,butwhoareknowntohavemultiplebirthsorareexpectedtohavebirthcomplications,orpregnantwomenwhohavegivenbirthinthepast7days.
5.2Restrictedcarriage
Passengerssubjecttocarriagerestrictionsinclude:injuredpassengers,children/infantsaccompaniedbyadults,unaccompaniedchildren,pregnantwomen,stretcherpassengers,etc.

Passengerwithinfectiousdiseasethatposesathreattothehealthofotherpassengersorcrewmembers,orpassengerwiththeinfectiousdiseasewhichiswithinthestatutorycompulsoryisolationperiodofthecountryandthestatutorycompulsoryisolationperiodofthedestinationcountry(internationalairline)
Note:SevereacuterespiratorySyndrome(SARS),whichisadirectthreat,spreadseasilyinthecabinenvironmentandcancauseseriousconsequences;Forexample,thecommoncoldiseasilytransmittedinthecabinenvironment,butdoesnotleadtoserioushealthconsequences,andAIDShasveryserioushealthconsequencesbutdoesnoteasilyspreadinthecabinofanaircraft,andisnotadirectthreat.
j)Passengerwhohasexperiencedsurgeryandwhoseairtravelmaybeharmfultothemselves.

5)Passengerwhorequiresintravenousinjection(s).
6)Passengerwhoissufferingfromotherdiseasesthatareconsideredmedicallyunsuitabletotravelbyair,ormaydeteriorateduringairtravel.
5.2.2Forinjuredpassengerswhodonothaveamedicalcertificateoffitnessforairtravelissuedbyadoctorinprovisions5.2.1,shalltruthfullyinformCSNandpresentrelevantmedicalcertificatessuchasdiagnosiscertificateanddischargecertificate.CSNwillassesswhetherthepassengerisfittoflyandmakearrangementsforcarriage.
5.2.3Infantsandchildrenunderfiveyearsoldmustbeaccompaniedbypassenger(s)whotravelinthesameclassofservice,andover18yearsoldwithfullcapacityforcivilconductandtheabilitytoescort.Thereisalimittothenumberofchildrenandinfantsthatcanbeaccompaniedbyeachpassenger.
5.2.4CSNonlyacceptspassenger(s)whoareatleastfiveyearsoldandundertwelveyearsoldasunaccompaniedminors.UnaccompaniedminorservicemustapplytoCSNinadvanceandproceedtoassociatedproceduresbeforetheyareallowedtotravel.
5.2.5Passenger(s)whoapplyforstretcherservicemustbeaccompaniedbypassenger(s)whotravelsinthesameclassofservice,andover18yearsoldwithfullcapacityforcivilconductaswellastheabilitytoescort.
5.2.6Pregnantwomenwhoareatleastmorethan32weekspregnantbutlessthan36weekspregnantshouldpresentapregnancytestreportoratrueandvaliddiagnosiscertificatewithadoctor'ssignatureornamestampindicatingthenumberofweeksofpregnancy,andsignarisknotificationletter,andthereportorcertificateshouldbeissuedwithin30daysbeforetheflight.
5.2.7Ifpassenger(s)haveanyofthefollowingsituations,theyarerequiredtoissueamedicalcertificateorcertificateofdiagnosisapprovedbyCSNbeforepurchasingaticketandtakingaflight:
a)Passenger(s)whoaretravellingwithprematureinfantincubators.
b)Passenger(s)whocarryacompliantportableoxygenconcentrator(POC)thatisrequiredforuseinflightandisphysicallyabletotravel.
c)Passengersapplyingforstretcherservice.
d)Passenger(s)whotravelbyairwillbedangeroustotheirhealthstatusorrequiredspecialmedicalcareinflight,includingmedicalconditionsnotmentionedinProvisions5.1.2and5.2.1butwhichmayoccurduringtheflightandleadtoundesirableimpactsonthehealthofthepassengersandthesafetyoftheflight.
e)Passenger(s)whosufferfromaseverecontagiousdiseasebuthavetakenprecautionarymeasurestopreventinfectingothers.
f)MentalpatientswhoareconsideredstablebylicensedmedicalinstitutionsormedicalstaffrecognizedbyCSNandaresuitableforairtravelaftertakingcertainmeasures.
g)WhereCSNhasreasonablegroundstobelievethatpassengerswithdisabilitycannotsafelycompleteairtravelwithoutmedicalassistanceduringtheflight.
5.2.8MedicalcertificatesorcertificatesofdiagnosismentionedatProvisions5.2.15.2.25.2.6and5.2.7approvedbyCSNthatrefertodiagnosesofapatient'sconditionissuedbyamedicalinstitutionatthesecondclassandabovelevel,signedbyadoctorofthatinstitutionandhavereceivedanofficialstampoftheofficialdocuments.Whencheck-inorboarding,thepassenger(s)mayberequiredtoproviderelevantmedicalcertificate.ForspecialrequirementsrelatedtomedicalcertificatesorcertificatesofdiagnosisapprovedbyCSN,suchasthetimeofissue,pleasecontactCSNformoreinformation.
5.3TreatmentswhenCarriageRefused
Forpassenger(s)beingrefusedtransport,CSNwillproceedinaccordancewiththefollowingprovisions:
5.3.1Passenger(s)beingrefusedtransportpursuanttoProvisions5.1.1f)andh)shallbesubjecttoinvoluntaryrefundorchangeofthepurchasedticketsaccordingtoProvisions8.3and9.3.
5.3.2Passenger(s)beingrefusedtransportpursuanttoProvisions5.1.1g),CSNreservestherighttodetainitsticketifnecessaryandreporttotherelevantauthorities.
5.3.3Passenger(s)beingrefusedtransportpursuanttoProvisions5.1.25.2.1shallbesubjecttoinvoluntaryrefundaccordingtoProvisions9.3wheneligible.
5.3.4Exceptasotherwiseprovidedabove,passengersshallbesubjecttovoluntaryrefundaccordingtoProvisions9.2.
5.4Passenger(s)mustunderstandthepossiblerisksofexperiencingsuddenillnessesduringflightandbearanysubsequentliabilitiesthereof,includingthecostsincurredbyairlinesoflandingatadiversionairport.Incaseofdiversion,relevantticketcouponshallbetreatedasused.Forpassenger(s)whoareawarethattheirsituationmakesthemunsuitabletofly,orpassengerswhosephysicalandmentalconditionsrequiringspecialcare,butwhoviolatetheconditionsofthiscontractbyconcealing,deceiving,ormisleadingothersoftheirsituation,CSNreservestherighttopursuelegalresponsibilityofthepassenger.
6.1GeneralRules
BaggagecarriedbyCSNisclassifiedascheckedbaggageandun-checkedbaggagebasedontheresponsibilityoftransportation.Fordetailsofbaggagesizerequirements,freebaggageallowance,excessbaggageandspecialbaggagetransportationandchargingstandards,pleaserefertotheCSNBaggageRules.
6.2ItemsUnacceptableasBaggage
6.2.1Dangerousgoods,exceptthosepermittedbyDangerousGoodsTransportationRegulationsofChinaCivilAviationandCSN’sregulations,areforbiddentobecarriedeitherascheckedorun-checkedbaggage:
a)Explosives,suchasfireworks,firecrackers,ammunition,confidentialbagsorboxescontaininglithiumbatteriesorpyrotechnicsubstances,etc.;
b)Gases,includingflammablegases,non-inflammableandnon-toxicgases,toxicgases,suchasliquefiedgas,teargas,pepperspray,etc.;
c)Flammableliquids,suchasalcohol,paint,etc.;
d)Flammablesolids,substancesliabletospontaneouscombustion;substanceswhich,oncontactwithwater,emitflammablegases,suchasmatches,magnesiumpowder,whitephosphorus,yellowphosphorus,etc.;
e)Oxidizingsubstancesandorganicperoxides,suchasbleachingpowder,hydrogenperoxide,peraceticacid,etc.;

6.2.3Itemsofwhichtheweight,dimensions,configurationornaturemakethemunsuitableforcarriageconsideredbyCSN.
6.2.4Liveanimals,exceptaspetsandservicedogsthatmeetCSN’srules.
6.2.5Firearmsandammunition,includingallkindsofsimulatedtoyguns,gun-typelightersandothertypesofoffensiveweapons,ammunition,ordnance,policeequipment(suchaselectricbatons,electricshockdevices,etc.)andimitationoftheaboveitems,controlledknives,exceptthoseapprovedorauthorizedbythecompetentauthoritiesoftherelevantcountries.
6.2.6Lightersandmatches.
6.2.7Lithiummetalbatteriesthatcontainlithiumthatexceed8grams,lithiumionbatteriesthatrateenergyexceed160Wh.Equipmentpoweredbylithiumbatteriesandsparebatteriesthatunclearlylabelledornotforpersonaluse.
6.2.8Lithiumbattery-poweredelectronicvehicles,includingthosebatteriesareremoved.Suchvehiclesrefertomobilityaidspoweredbylithiumbatteriesthatcarrypeople,whichincludesbutnotlimittoairwheel,solowheel,hoverboard,mini-Segway,balancewheel.
6.2.9Anyitemthatastrangeraskstocarryforhim/her.
6.3ItemsUnacceptableasCheckedBaggage

b)Electronicsmokingdevices(e.g.e-cigarettes).
6.4ItemsUnsuitableasCheckedBaggage
Thefollowingitemsthatrequirepersonalcarearenotsuitabletobecarriedascheckedbaggageorplacedincheckedbaggage,whereastheyshouldbebroughtintothecabinasuncheckedbaggage.Ifsuchitemsincludedincheckedbaggagearelostordamaged,CSNisliableforthemonlyascommoncheckedbaggage.
a)Fragileoreasilydamageditems,suchasphotography,videooropticalequipment,clocks,porcelain,etc.;
b)Perishableitems;
c)Valuables,unique,irreplaceableorsimilaritems,suchascash,valuabletickets,jewelry,preciousmetalsandtheirproducts,antiquecalligraphyandpaintingandsamples,familyheirloom,keys,etc.;
d)Importantdocuments,materialsandbooks,securitiesornegotiableinstruments;
e)Travelingdocuments;
f)Medicalcertificates,X-rayfilms,orthoticsorsurgicalstents;
g)Prescribeddrugsthatneedtobetakenregularly.
6.5ItemswithLimitationonCarriage
6.5.1CSNhasstrictquantityrestrictionsandpackagingrequirementsforthecarriageoffollowingitems.TheymaybeacceptedascheckedbaggageonlyinaccordancewithCSN’sregulationsandwiththeconsentofCSN.
a)Precisioninstrumentsandelectricappliancesshallbetransportedascargo.Iftransportedascheckedbaggage,suchitemsmustmeetthefactorypackagingorsimilarpackagingstandardsandthefreebaggageallowancewillnotapplytosuchitems.
b)Sportingequipment,includingfirearmsandammunitionforhuntingandsportingpurposes.ThetransportationofsuchfirearmsandammunitionshallbeinaccordancewithapplicablelawsandregulationsaswellasCSN’srules.
c)Sharpandbluntobjectsotherthancontrolledknives,suchasswords,knives,handicraftknives,kitchenknives,fruitknives,tableknives,scalpels,scissors,steelfiles,axes,sticks,hammersandothersimilararticlesbelongingtoantiquesortouristsouvenirs,etc.;
d)Dryiceforpackagingfreshitems;

6.5.2Seat-takingBaggage
ItemsthataretoobigortooheavytomeetCSN'suncheckedbaggagerequirementsshouldbetakenintothecabinasseat-takingbaggage.Suchitemswillbechargedforextrafeesseparatelyandwillbekeptbythepassenger(s).
6.5.3Freshandperishableitems
Freshandperishableitemsarethosethatwilllosetheirintrinsicpropertiesorqualitiesandthuscannotperformtheirintendedfunctionswithoutmeetingtheirrequiredstorageconditions.Itemsincludedaremedicines(vaccinesandpharmaceuticals),electroniccomponents,fruits,vegetables,meat,fish,seafood,dairyproducts,flowers,pastriesandotheritemsvulnerabletounsuitablestorageconditions.Freshandperishablegoodsmusthaveappropriatepackaging,andthepackagingmustnotcontainliquidsubstancessuchaswater;Theouterpackagingofitemsthatareafraidofpressureshouldbestrongandresistanttopressure;Thereshouldbeairholesonthepackagingofarticlesrequiringventilation;Containersforrefrigerateditemsshouldbetight.
6.5.4Aquaticproducts
Aquaticproductsareonlyeligiblefortransportationondomesticflights.Thepackagingmaterialsofaquaticproductsshouldbecorrugatedcartons,foamboxes,plasticbags,tapeandotherauxiliarymaterials.Thepackagingshouldbesecuredwithnoleaking,emissionofundesirableodor,andwillnotdamagethepassengers'baggage,aircraftfacilities,equipmentandothercargo.Thepackagingshouldwithstandsuddenchangesintemperatureandpressureandmusthaveacertaincompressivestrengthtoensurethatitwillnotbedamagedduringnormalairtransportation.
6.5.5Dryice
Nomorethan2.5kgofdryiceperpassengerisallowedforthepreservationofliveitems.Dryicepackagesshouldhaveairholes,andwhenusedascheckedbaggage,thebaggageshouldbelabeled"solidcarbondioxide"or"dryice",andthenetweightofdryiceorindicatedthatitsnetweightdoesnotexceed2.5kg.
6.5.6Mercurybarometerormercurythermometer
Eachrepresentativeofagovernmentweatherbureauorsimilarofficialagencymaycarryonlyonebarometerorthermometer,mercuryfilledasuncheckedbaggage,anditmustbepackedinastrongouterpackaging,whichwillpreventtheescapeofmercuryfromthepackage.
Medicalorclinicalthermometerswhichcontainsmercurycanonlybetransportedascheckedbaggage.Onepersoncancheck-inonlyonesuchthermometerinitsprotectivecase.
6.5.7ElectronicdevicesandSparebatteries
6.5.7.1Passengerscarryingportableelectronicequipmentpoweredbylithiumbatteriesarerequiredtomeettheprincipleofpersonaluse,andsparebatteriesmustbecompatiblewiththeportableelectronicequipment.
6.5.7.2Portableelectronicequipmentandsparebatterieswithlithiummetalbatteriesthatcontainlithiumthatdonotexceed2grams,orlithium-ionbatteriesthatrateenergydonotexceed100Wh,arenotrequiredtobedeclared.Eachpersonmaybeallowedtocarryamaximumof15portableelectronicdevicesandnomorethan20sparebatteriesasun-checkedbaggage.
6.5.7.3Portableelectronicequipmentandsparebatteriesthatcontainlithiummetalbatteriesthatexceed2gramsbutnotexceed8grams,orlithium-ionbatteriesthatrateenergyexceed100Whbutdonotexceed160Wh,arerequiredtobedeclaredatthetimeofcheck-inorboarding.Suchkindoflithiummetalbatteriesareonlypermittedforuseinportablemedicalelectronicdevices(PMED),andsparebatteriescanonlybecarriedin2piecesandonlyasun-checkedbaggage.
6.5.7.4Ifthelithiumcontentofthelithiummetalbatteryexceeds0.3g,ortheratedenergyofthelithiumionbatteryexceeds2.7Wh,theelectronicdeviceinthecheckedbaggagemustbecompletelyturnedoff(notinsleeporhibernationmode)andprotectedagainstdamage,andthedevicemustbepreventedfromaccidentallystarting.
6.5.8ElectronicWheelchairs
6.5.8.1Forelectricwheelchairsorwalkersequippedwithlithiumbatteries(hereinafterreferredtoaselectricwheelchairs),passengersshouldcontactCSNinadvanceandprovidethemodelinformationoftheinstalledbatteryandthemanufacturer'soperatinginstructions.BatteriesmustmeetalltestrequirementsoftheUnitedNationsManualofTestsandCriteria,PartIII,Section38.3.
6.5.8.2Ifthebatterydesignissufficientlyprotectedagainstdamagetothebatteryandcanbesecurelysecuredtotheelectricwheelchair,thebatterypolesmustbeprotectedagainstshortcircuits(e.g.thebatteryisenclosedinabatterycase),thecircuitcanbedisconnectedaccordingtothemanufacturer'sinstructions,andtheelectricwheelchaircanbetransportedascheckedbaggage;Ifthedesigndoesnotprovideadequateprotectionforthebattery(forexample,thebatteryissimplyexternalorcannotbesecurelysecuredwithoutanadditionalprotectivecase),thepassengershouldremovethebatteryashandluggageaccordingtothemanufacturer'sinstructions,andthebatteryremovedfromthewheelchaircannotexceed300Wh.
6.5.8.3Eachpassengercancarryamaximumofonesparebatterynotexceeding300Wh,ortwosparebatteriesnotexceeding160Wheach,ashandluggage.Batteriesusedashandluggagemustbeprotected,suchasplacingeachbatteryinaprotectivecase.
6.6RighttoRefuseCarriage
CSNmayrefusetocarrythepassenger'sbaggageforanyofthefollowingreasons:
6.6.1Ifthesize,weightorquantityofuncheckedbaggageexceedsthestandardsetbyChinaSouthernAirlines,passengersshouldtaketheinitiativetocheckinatthecheck-incounterorself-servicebaggagedeliveryequipmentinadvance.ThestaffatBoardinggatewilltransfertheuncheckedbaggagetocheckedBaggageifexceedingthestandard,andtheneedtore-checkthesecuritymaycausethefailuretoarriveonthesameplane,CSNisnotresponsibleforthepossiblecostsandlosses.
6.6.2CSNmayrefusetocarryorcontinuetocarryapassenger'sbaggageifitcontainstheitemslistedinProvision6.2,orifthecheckedbaggagecontainstheitemslistedinProvision6.3or6.4.
6.6.3CSNmayrefusetocarryapassenger’sbaggageifthepassengerhascarriedtheitemslistedinProvision6.5andhasfailedorrefusedtocomplywiththeconditionsofcarriageforCSN.
6.6.4UnlessadvancearrangementsforitscarriagehavebeenmadebyCSN,excessbaggagemaybetransportedwithasubsequentflight.
6.6.5Baggagethathavenotbeenthroughsecuritycheck.
6.6.6Baggagewhoseouterpackingorcontentsdonotmeettherequirementsfortransportattheoriginalpoint,transitionpointordestinationpoint.
6.6.7Thecarriageofapassengerorpassenger'sbaggageviolatesanyapplicablelaw,regulationororderofthecountryoforigin,destination,transitionpointoroverflight.
6.6.8Thecarriageofpassenger(s)orbaggagemayendangeroraffectthesafety,health,convenience,comfortofotherpassengersorcrewmembers.
7.1GeneralRules
7.1.1Theflighttimeor/andaircrafttypespecifiedintheflightscheduleissubjecttochangebetweenthedateofitspublicationandthedateonwhichthepassengeractuallycommencesthetrip,andCSNdoesnotguaranteesuchflighttimeoraircrafttype,andsuchflighttimeoraircrafttypedoesnotformpartofthecontractofcarriagebetweenCSNandthepassenger.
7.1.2CSNwilltakeallmeasuresthatcanbereasonablyrequiredtoavoidflightdelay,cancellationanddiversionofflight.IfCSNhavetakenallmeasuresthatcanbereasonablyrequiredoritisimpossibletotakesuchmeasures,unlessotherwiseprovidedforinChineselawsandinternationalconventions,CSNwillnotbeliableforanylossescausedtothepassenger,oranyfurtherlosscausedbythepassenger'sfailuretotakeappropriatemeasures.
7.2Servicesafterflightdelays,cancellationsanddiversions
7.2.1Ticketingservice
Iftheflightiscancelled,delayedatdeparture,earlydeparturedordiverted,ortheconnectingtimeofthepassenger(s)immediateconnectingflightisrenderedshorterthantheminimumconnectingtimeduetoflightdelays,CSNwillundertaketheinvoluntarychangesandinvoluntaryrefundsprocedureforthepassenger(s)inaccordancewithProvision8.3or9.3respectivelyasvalidatingcarrier.
7.2.2Informationservices
Iftheflightisearlydepartured,delayedorcancelledatdeparture,CSNwillprovideyouwithflightstatusinformationaccordingtotheprocedure.
7.2.3Mealsandaccommodationservices
7.2.3.1IftheflightisdelayedorcancelledatdepartureduetothereasonsattributabletoCSN,CSNwillprovidewithmealsandaccommodationservicesaccordingtotheprocedures.
7.2.3.2IftheflightisdelayedorcancelledatdepartureduetoreasonsnotattributabletoCSN,CSNwillhelparrangemealsandaccommodations,butwillnotberesponsibleforallrelatedexpensesincurred.
7.2.3.3CSNwillprovidemealsoraccommodationsiftheflightisdelayedorcancelledatdepartureintheagreedtransitionpointortheflightisdiverted.
The‘delayatdeparture’referredtoinProvision7.2.3meanstheactualdeparturetimeoftheaircraft(i.e.thewheelblockshavebeenremoved)exceeds15minuteslaterthantheflightscheduleddeparturetime,excludingthecasewherethedeparturetimeoftheflightislaterthantheoriginalplanneddeparturetimeduetotheadjustmentoftheflightplan.
The‘cancellation’meansthesituationwheretheflightplansterminateduetoanticipatedflightdelaysorthedelaysresultintheterminationoftheflightplans,notincludingcaseswheretheflightoccursscheduledchangeorterminatedbyotherreasons.
7.2.4CompensationforFlightDelaysonArrival
IftheflightisdelayedonarrivalduetothereasonsattributabletoCSNsuchasmaintenance,flightscheduling,crew,etc.,CSNwillprovidecompensationtopassengersbasedontheactualdelaytime.
7.2.4.1¥200RMBperpassengerwillbecompensatedforflightsdelayedonarrivalbyormorethanfourhoursbutlessthaneighthours.
7.2.4.2¥400RMBperpassengerwillbecompensatedforflightsdelayedonarrivalbyormorethaneighthours.
The‘flightdelayonarrival’referredtoinProvision7.2.4meansthearrivaltimeoftheaircraftarriveatthedestinationgate(i.e.thewheelblockshavebeenplaced)exceeds15minuteslaterthanthescheduledarrivaltime,excludingthecasethatduetoflightschedulechangeleadingtotheflightarrivaltimelaterthantheoriginalplannedarrivaltime.
7.2.5CSNshallprovideserviceswhereflightdelays,cancellationsanddiversionsoccurasspecifiedinProvision7.2forpassengers.CSNshallassumenofurtherliability,unlessotherwiseprovidedinothercompulsoryandprohibitorylawsoradministrativeregulations,inwhichcase,theabove-mentionedlawsorregulationsshallapply.
8.1GeneralRules
8.1.1Ticketchangeshallbeconductedwithinthevalidityperiodoftheticket.
8.1.2Passenger(s)shallcontactthevalidatingcarrieroritssalesagentforticketchange.
8.2VoluntaryChange
8.2.1Voluntarychangemeansthatapassengerrequestsforachangeintheticketforthepassenger(s)ownreasons.
8.2.2Ifapassenger,afterpurchasingaticket,requestsavoluntarychange,CSNanditssalesagentsshallhandletherequestontheconditionthatthereareseatsavailableandinaccordancewithconditionsoftheuseofticket.Atthetimeofthechange,thefare,taxes,feesandchargeswillbecalculatedagainaccordingtotheconditionsofuseofticket.Forthechargeofchangefee,thedomesticticketchangefeeshallbechargedaccordingtotheticketuseconditionscorrespondingtoeachflightsegment,whiletheinternationalticketchangefeeshallbechargedaccordingtothestricterticketuseconditionsofeachflightsegment.
8.3InvoluntaryChange
8.3.1Ifapassengerneedstochangetheticketduetothefollowingcircumstances,CSNanditssalesagentscangrantinvoluntarychangeoncetotheticketforpassenger’sflightandpassenger’simmediateconnectingflight,withoutanyticketchangefeecharged.
a)Underthecircumstanceswherepassenger’sflightdelaysordepartsearlierthanscheduled,cancelled,reroutingortheclassofservicechanges,orthecarrierwasunabletooperatetheoriginalflightduetoreasonsattributabletoornotattributabletoCSN,passengerneedstochangetheticket.
b)Underthecircumstanceswherepassenger’sflightisdelayedonarrivalandtheconnectingtimeofthepassenger(s)immediateconnectingflightisrenderedshorterthantheminimumconnectingtime,passengerneedstochangetheticket.
IfapassengertravellingwithCSN’sflightrequestsinvoluntarychangeduetoabove-mentionedreasons,notattributabletoCSN,CSNwill,takingintoaccountthereasonableneedsofthepassenger,giveprioritytothepassengeronaCSNflightwithavailableseats,or,aspermittedbytheconditionsofuseoftheticketandwiththeconsentofthepassengerandthecarrierconcerned,conductanendorsementandtransportthepassengertothedestinationorstopoverpoint.
IfapassengertravellingwithCSN’sflightrequestsinvoluntarychangeduetoabove-mentionedreasonsattributabletoCSNwill,takingintoaccountthereasonableneedsofthepassenger,giveprioritytothepassengeronaCSNflightwithavailableseats,or,withtheconsentofthepassengerandthecarrierconcerned,conductanendorsementandtransportthepassengertothedestinationorstopoverpoint.
8.3.2Rangeofinvoluntarychangesofflightdates
Ifapassengerdoesnotacceptarrangementmadebythecarrierwheninvoluntarychangeoccurs,thepassengercanchangetheflightonceforfree.Forinternationalorregionalflight,thenewtraveldatecanbeselectedwithin7daysbeforeand14daysaftertheoriginaltraveldateoftheaffectedflightorthesubsequentflight.Fordomesticflights,thenewtraveldatecanbeselectedwithin7daysbeforeandaftertheoriginalflightdateoftheaffectedflightorthesubsequentflight.IfthereisnoavailableCSNflightwithinthedaterangementionedabove,freechangetothenextavailableflightisallowed,butonlyforonce.
8.3.3Ticketsthatmeetthefollowingconditionsmaybemadeasecondinvoluntarychangefreeofcharge:
a)Passengersandchildrentravellingwiththemcanbechangedtothesameflightfreeofchargeiftheyareaccommodatedtoadifferentflight.
b)Passengersinthesamepurchaseorderwhoarechangedtoadifferentflightcanbechangedtothesameflightfreeofcharge.
c)TheconnectingflightofCSNischanged,andthechangedflightcannotbeconnectedortheconnectingtimeoftheflightexceeds240minutes,asecondchangecanbemadefreeofcharge.
d)Iftheflightresumedaftercancellation,passengerswhohavebeeninvoluntarilychangedortransferredcanmakeasecondchangetotheresumeflightfreeofcharge.
e)IftheCSNflightchanges,passengerswhohavebeeninvoluntarilytransferredtootherairlinescanmakeasecondchangetotheflightcarriedbyCSNfreeofcharge.
8.3.4Forticketswhereinvoluntarychangeshavebeengranted,ifpassengerrequestsachangeorrefundagainduetotheirownreasons,passenger’srequestsaresubjecttotheprovisionsin8.2or9.2oftheseConditionsofCarriage.
8.4Circumstanceswherechangesarerequestedduetohealthreasons.
Passengerswhocannottravelontheflightsordatesspecifiedintheticketduetoinjury,illnessorotherhealthreasonsofthemselvesortheircompanions,canrequestachangetotheunusedsegmentoftheticketfreeofchangefeewithinthevalidityperiodoftheticketbypresentingthecertificationmaterials.CSNhasspecificrequirementsonthetypesofcertificationmaterialsandhandlingrules,passengersshouldcontactCSNtounderstandandhandleaccordingtoregulations.
9.1GeneralRules
9.1.1General
9.1.1.1Thepassenger(s)shallcontactthevalidatingcarrieroritssalesagentsforrefund.
9.1.1.2Applicationforrefundwillonlybeacceptedwhenthecoupon’sstatusisOPENFORUSE.
9.1.1.3Applicationforrefundmustbesubmittednolaterthanonemonthaftertheticket’svalidityperiodexpiresasspecifiedinprovision3.1.2oftheseConditions.Applicationforrefundbeyondtheabovetimelimitwillnotbeprocessed.
9.1.1.4Thepassenger(s)whohaveprintedthee-ticketitinerary/receiptshallreturnthee-ticketitinerary/receiptwhenrequestingarefund.
9.1.2PersontoWhomtheRefundWillbeMade
9.1.2.1CSNwillgiveprioritytorefundthetickettotheoriginalpaymentaccount,ortothepassengeriftheticketcannotberefundedtothepaymentaccountduetospecialreasons.
9.1.2.2Thepassenger(s)orpayershallpresenthis/hervalididentitydocumentwhenrequestarefund.Incaseswherepassengerentrustsanotherpersontohandletherefundprocedureonhis/herbehalf,theproxyshallpresentavalididentitydocumentforthepassengerandhimself/herself,togetherwitharefundauthorizationletter.
9.1.2.3InaccordancewithProvision9.1.1,arefundmadetoanyoneholdinghimselfasapersontowhomrefundmaybemadeintermsofProvision9.1.2.shallbedeemedaproperrefund;meanwhileCSNshallbedischargedfromliabilityandanyfurtherclaimforrefund.
9.1.3Currency
9.1.3.1Ifapassengerrequestsarefund,itmustcomplywiththelawsandotherrelevantregulationsofthecountrywheretheticketwasoriginallypurchasedandtheplaceofrefund.CSNmayrefundthemoneyinthecurrencyinwhichtheticketwasoriginallycollected,orinothercurrenciesspecifiedbyCSN.
9.1.3.2Passenger(s)shallnotbeentitledtolodgeclaimsagainstCSNforthedifferencearisingfromcurrencyexchange.
9.2VoluntaryRefunds
9.2.1Voluntaryrefundsmeanthatapassengerrequestsaticketrefundforhis/herownreasons.Voluntaryrefundsshallbeprocessedinaccordancewiththeconditionsofuseoftheticketapplicabletotheticket.
9.2.2Passenger(s)canapplyforvoluntaryrefundthroughtheoriginalticketpurchasechannel.
9.2.3Ifapassengervoluntarilyterminateshistravelatthetransitionpoint,thefarefortheunusedsegmentoftheflightwillnotberefunded.
9.3InvoluntaryRefunds
9.3.1Ifapassengerrequestsforticketrefundsduetothefollowingcircumstances,CSNanditssalesagentscangrantinvoluntaryrefundforpassenger’sflightandpassenger’simmediateconnectingflight,withoutanyticketrefundfeecharged.
a)Underthecircumstanceswherepassenger’sflightdelays,departsearlierthanscheduled,cancelled,reroutingortheclassofservicechanges,orthecarrierwasunabletooperatetheoriginalflightduetoreasonsattributabletoornotattributabletoCSN,passengerrequestsforticketrefunds.
b)Underthecircumstanceswherepassenger’sflightisdelayedonarrivalandtheconnectingtimeofthepassenger(s)immediateconnectingflightisrenderedshorterthantheminimumconnectingtime,passengerrequestsforticketrefunds.
9.3.2Passenger(s)canapplyforinvoluntaryrefundbycontactingCSNorthroughtheoriginalticketpurchasechannel.
9.3.3Ifnoportionofthetickethasbeenused,thefarepaidshallberefundedtogetherwiththerefundabletaxesandcharges.Ifaportionofthetickethasbeenused,applicablefaresandrefundabletaxesforunusedsegmentsshallberefunded.Therefundedamountshallnotbehigherthantheamountpaid.
9.3.4Changefeeshallbepaidbypassengerwhorequiresflightchangeofhis/herownwill.Whenthechangedflightisnotperformedasscheduled,theticketcanberefundedfreeofchargewhilethepreviouslypaidchangefeeshallnotberefunded.
9.4Circumstanceswhererefundsarerequestedduetohealthreasons.
Passengerswhocannottravelontheflightsordatesspecifiedintheticketduetoinjury,illnessorotherhealthreasonsofthemselvesortheircompanions,canrequestforticketrefundstotheunusedsegmentoftheticketfreeofchargewithinthevalidityperiodoftheticketbypresentingthecertificationmaterials.CSNhasspecificrequirementsonthetypesofcertificationmaterialsandhandlingrules,passengersshouldcontactCSNtounderstandandhandleaccordingtoregulations.
10.1GeneralRules
10.1.1Inordertofulfillmorepassenger(s)travelneedsandreducetheseatsthatmightotherwisegoemptyduetotemporarycancellationoftravelplansbysomepassengers,CSNmightoverbooksomeflightstoareasonableextent.CSNwilltakeintofullconsiderationtheroutes,flightschedules,times,aircrafttypesandflightconnectionstocomeupwithreasonableproportionofoverbookingstothenumberofavailableseatsoneachflightsothatthenumberofpassengersbeingdeniedboardingduetooverbookingcanbeminimized.
10.1.2Iftheactualnumberofpassengersonboardexceedstheactualnumberofavailableseatsduetooverbooking,CSNwilllookforpassengerswhovoluntarilygiveuptheiritineraries,basedonourproceduresforsolicitingvolunteers.IncaseswhereCSNfailtohaveenoughpassengerswhovoluntarilygiveupthetrip,CSNmaydenyboardingtooneormorepassengersontheoverbookingflightaccordingtotheboardingpriorityrules,andprovideappropriatecompensationandservices.CSNcanissueproofofdeniedboardingforpassengersuponrequest.
10.2Applicability
CSNoverbookingprocedureappliessolelytoflightsactuallyoperatedbyCSNwhereoverbookingoccurs.
10.3InformationnotificationandProcedureforSolicitingVolunteers
10.3.1Ifanoverbookingoccursonaflight,CSNwillreleaseinformationabouttheoverbookedflightthroughtelephone,textmessages,noticesoron-sitebroadcastsbeforeflightdeparture,solicitvolunteerswhoarewillingtogiveuptheiritineraries,andmakecleartherelevantcompensationandservicestandards.
10.3.2Afterobtainingtheconsentofvolunteers,thecompensationprocedureswillbecarriedoutforthepassenger(s)andthepassenger(s)willfillinthe‘CompensationandReleaseofLiabilityforInvoluntaryPassengersAbandoningtheFlight’.
10.3.3Iftherestillareavailableseatsbeforethedepartureoftheoverbookingflight,thevolunteerscancontinuetheiroriginaljourney.
10.3.4Ifthevolunteersarenotabletoboardtheoverbookingflight,compensationandservicewillbeprovidedaccordingtothestandardagreedbyCSNandvolunteers.
10.4BoardingPriorityRules
Iftherearenotenoughvolunteers,CSNmayinvoluntarilydenyboardingtooneormorepassenger(s).Boardingpriorityisgiventocertainpassengers,includingtothosewho:
a)Areonurgentnationalbusiness.
b)Havespecialserviceneeds,suchastheelderly,young,sick,disabled,pregnantandunaccompaniedchildren/youth,asagreedbyCSNandarrangedinadvance.
c)HoldingFirstorBusinessClasstickets.
d)MembersofChinaSouthernAirlinesPlatinum,GoldandSilverSkyPearlClubcards.
e)Havebookedseatsonconnectingflightswithashortconnectingtime.
f)Canprovethattheyhavespecialdifficultiesandarerequiredforairtravel.
10.5OverbookingServiceandCompensation
10.5.1Ifpassenger(s)voluntarilygiveuptheiritinerariesorareinvoluntarilydeniedboardingduetooverbooking,CSNwillarrangetheearliestavailableflightforthepassenger(s),orproceedaninvoluntaryrefund.
10.5.2Forpassenger(s)whovoluntarilygiveuptheiritinerariesduetotheprocedureforsolicitingvolunteers,compensationandservicewillbeprovidedaccordingtothestandardagreedbyCSNandvolunteers.

11.1GeneralRules
11.1.1Exceptasotherwisespecified,CSNdoesnotprovidepassenger(s)withsuchgroundcarriageastransportationwithintheairportarea,betweenairportsorbetweenairportsanddowntown.CSNisnotresponsiblefortheactionsofcertainserviceprovidersorforanyassistancegivenbyanyauthorizedagentsorrepresentativesofCSNinobtainingthisserviceforthepassengers.
11.1.2Exceptasotherwisespecified,groundaccommodationsandmealsattheconnectingpointofconnectingflightsshallbeattheexpenseofthepassenger.
11.2AdditionalOptionalServices
11.2.1Inadditiontotheservicesprovidedfreeofcharge,onsomeroutesorindifferentservicescenarios,CSNmayprovidepassenger(s)withpaidservices,includingbutnotlimitedtopaidupgradeormeals.Passenger(s)maypurchasesuchadditionalproductswithcashorFFPmileageviaCSN’savailablesaleschannels.
11.2.2CSNwillannouncerelatedcontentsofadditionaloptionalservicesthroughpublicchannelssuchastheofficialwebsiteandCSNmobileapplication.Suchcontentsinclude,butnotlimitedto:producttypes,standards,prices,applicableconditions,purchaseandchangeprovisionsandotherrelatedinformation.AbovecontentandinformationaresubjecttothefinalannouncementspublishedbyCSN.
11.2.3Afterpassenger(s)purchasesadditionaloptionalservices,CSNwillprovidethepassenger(s)withfollowinginformation,whichinclude,butnotlimitedto:passengername,flightnumber,dateoftravel,specifiedserviceandrelatedinformationinvolvedinthepurchasedservice.
11.2.4Atthetimeofcheck-in,passenger(s)shouldproactivelypresentadditionalserviceconfirmationorverballyinformthestaffwhethertheywishtousethepurchasedadditionalserviceproducts.
11.2.5Ifcertainadditionalservicerulesareagainstlawsorregulations,thecorrespondinglawsandregulationsshallprevail.
11.2.6Ifpassenger(s)areunabletousetheirpurchasedadditionalserviceproductsduetoreasonsattributabletoCSN,thepassengershallrefundadditionalserviceproductswithinthevalidityperiodoftheproduct.Ifpassenger(s)areunabletousetheirpurchasedadditionalserviceproductsduetoreasonsnotattributabletoCSN,involuntaryrefundswouldbeproceededafterconfirmingthattheadditionalserviceproducthasnotbeenused.
11.2.7IfCSNarrangesservicesprovidedbyathirdpartyforpassengersotherthanairtransportation,orissuesaticketorvoucherrelatingtotransportationorservicessuchasgroundtransportation,hotelreservationsorcarrentalthatprovidedbyathirdparty(servicesotherthancarriagebyair),insuchcasesCSNonlyperformsasanagentofthepassenger(s)andtakesnoresponsibilityfortheavailabilityorthequalityoftheseservices.Thetermsandconditionsofthethird-partyserviceproviderwillapplythereof.
12.1GeneralRules
12.1.1Ourliabilityfordamagesincurredbythepassenger(s)duringairtransportationisboundbyChineselaw,applicableinternationalconventionsandtheseConditionsofCarriage.CSNisonlyliablefortheactualdamagecausedbyCSN’sactualairtransportationactivitiesinaccordancewiththeseConditionsofCarriageandthelimitsofliabilitystipulatedbyChineselawsorapplicableinternationalconventions.IfnoChineselawsorapplicableinternationalconventionscanbecited,theseConditionsofCarriageapply.Thetransportationresponsibilitiesofothercarriersrelatedtothepassenger(s)travelaresubjecttothelawsofthecountrylocatedandtheconditionsofcarriageofthecarriersinquestion.
12.1.2CSNshallnotbeliableforanylosscausedbyCSN'sperformanceofstatutoryobligationsorcompliancewithadministrativeorders,orpassenger'sfailuretoperformstatutoryobligationsorcomplywithadministrativeorders.Ifthedamageiscausedbythepassenger(s)fault,accordingtotherelevantlawsandregulations,theliabilityofCSNshallbeexemptedorreducedaccordingly.
12.1.3TheliabilityofCSNshallnotexceedtheamountofactuallossofthepassenger(s).CSNshallfurthermorenotbeliableforanyindirectorconsequentialdamagescausedthereby.
12.1.4TheaggregateamountrecoverablefromCSNandfromsuchagents,employeesandrepresentatives,shallnotexceedtheamountofCSN'slimitofliability.
12.1.5CarriageconductedbyCSNandothercarriersaccordingtooneticketorconsecutiveticketsshallberegardedasasinglecarriage.Nevertheless,withrespecttocheckedbaggage,passenger(s)maymakeaclaimagainstthefirstorlastcarriershownontheticketorbaggagetag.InthecaseofacodeshareflightwhereCSNisthecarrieroperatingtheflight,butdoesnotissuetheticket,CSNisliableonlyfordamageoccurringonitsownoperatingflight.IfCSNissuestheticketforacodeshareflight,itisliableforbaggageclaimsevenincaseswherethebaggageisbeingcarriedbyanotheroperator.Exceptasprovidedabove,CSNissuingaticketorcheckingbaggageoverthelinesofanothercarrierdoessoonlyasagentforsuchothercarrier.
12.1.6CSNreservestherighttoapplyanyprovisionsofinternationalconventionsandlawsconcerningtheexclusionandlimitationofthecarrier'sliability.
12.2Liabilityforcompensationforpersonalinjury
12.2.1Eventsthatoccuronacivilaircraftorduringtheembarkationonordisembarkationfromacivilaircraft:forlossesfromthepersonalinjuryordeath,whenitcomestodomesticairtransportation,CSNwillbeliablebasedonthe"CivilAviationLawofthePeople'sRepublicofChina"andthestate'srelevantprovisionsonthelimitationsofliabilityindomesticairtransportation;whenitcomestointernationalairtransportationdefinedbyinternationalconventions,CSNwillbeliablebasedonsuchinternationalconventions;whenitcomestotheinternationalairtransportationnotdefinedbytheWarsawConvention,theHagueProtocol,ortheMontrealConvention,CSNshallassumethelimitationofliabilityinaccordancewithApplicablelawsandregulations.
12.2.2Ifpassenger(s)ageormentalorphysicalconditionposeanyhazardorrisktohimselforherself,CSNshallnotbeliableforanyillness,injuryordisability,includingdeath,attributabletosuchconditionortheaggravationofsuchcondition.
12.3LiabilityforDamagetoBaggage
12.3.1Forlossesarisingfromthedestruction,lossordamageofthecheckedbaggage,aslongastheeventthatcausedthedestruction,lossordamagehasoccurredontheaircraftorduringanyperiodwherethecheckedbaggageisunderCSN’scontrol:fordomesticairtransportation,CSNassumeresponsibilitybasedonthe"CivilAviationLawofthePeople'sRepublicofChina"andthecountry'srelevantdomesticairtransportationcarrierliabilitylimits;forinternationalairtransportationdefinedbyinternationalconventions,theliabilityprovisionsofthecorrespondinginternationalconventionsshallapply;forinternationalairtransportationnotdefinedbytheWarsawConvention,theHagueProtocol,andtheMontrealConvention,CSNshallassumethelimitationofliabilityinaccordancewiththeapplicablelawanditsprovisions.
12.3.2CSNshallnotbeliableforanylossofcheckedbaggagecausedsolelybyitsnaturalproperties,qualityordefects.
12.3.3UnlessthelossoccursbythemisconductofCSN,CSNagentsandemployees,CSNshallnotbeliableforthelossofthepassenger(s)uncheckedbaggage.
12.3.4Ifthebaggageweightisnotrecordedonthebaggagetag,thetotalweightofthecheckedbaggageshallbedeemednottoexceedthefreebaggageallowanceapplicabletotherespectiveclassofserviceasstipulatedbyCSN.
12.3.5CSNshallnotbeliableforthelossofthepassengerorhis/herbaggagecausedbythecontentsinthepassenger'sbaggage.Ifthecontentsofpassenger'sbaggagecauseinjurytoothersordamagetootherpeople'sbelongingsorpropertyofCSN,suchpassengershallcompensateCSNforthelossandallexpensesincurredtherefrom.
12.3.6CSNshallnotbeliableforanyloss,damageorconfiscationofitemsinthebaggageofpassengerswhichshallnotbecarriedasbaggageorcheckedbaggageasspecifiedintheprovision6.2and6.3oftheseConditions,exceptasotherwiseprovidedforbyChineselawsandinternationalconventions.
12.3.7CSNshallnotbeliableforbaggagedelay,lossordamagecausedbyactionsrelatedtobaggageinspectioncarriedoutbyrelevantgovernmentdepartments,airportmanagementauthoritiesorsecurityinspectionagencies.
12.3.8CSNwillonlybeliableforlossofordamagetoitemslistedinprovision6.4oftheConditionsincheckedbaggageinaccordancewiththenormalcheckedbaggagecompensationlimits.
12.3.9CSNshallnotbeliableifitprovesthatithastakenallnecessarymeasuresorthatitisimpossibletotakesuchmeasuresinordertoavoidthelossofdelayedcheckedbaggage.
12.3.10Thepassenger'sacceptanceofcheckedbaggagewithoutobjectionshallbeprimafacieevidencethatthecheckedbaggagehasbeendeliveredingoodconditionandinconformitywiththetransportdocument.Intheeventofanylossofcheckedbaggage,thepassengermustnotifyCSNimmediately,nolaterthansevenworkingdaysfromthedateofreceiptofthebaggage;Inthecaseofdelayedbaggage,noticeshallbemadetoCSNnolaterthantwenty-oneworkingdaysfromthedateonwhichthebaggageisplacedinthecustodyoftheaddressee.Anysuchnoticemustbemadeinwritingwithinthetimelimitspecifiedabove,otherwisenoclaimcanbefiledagainstCSN.

14.2Internationalairtransportationmeansthetransportationwhere,accordingtothecontractoftransportationsigned,theplaceofdeparture.orthedestinationortheagreedstoppingplace,whetherornotthereisabreakinthetransportationoraconnection,isnotsituatedinthePeople'sRepublicofChina.
14.3CSNmeansChinaSouthernAirlinesCompanyLimited.
14.4Conventionmeanswhicheverofthefollowinginstrumentsthatisapplicable:

14.5CSN’sRegulationsmeansrules,otherthantheConditions,publishedbyCSNandineffectonthedateofpublication,governingthecarriageofpassengersand/orbaggageandshallincludeanyapplicabletariffsineffect.
14.6Carriermeansallpublicairtransportenterprisesthatissueairtickets,carryorundertaketocarrypassengersandbaggagelistedinairtickets.
14.7ValidatingCarriermeansthecarrierwhichmakesacontractofcarriagewithpassengersusingitsownticketnumberwithIATAcodeandwhosenumericcodeisindicatedintheticket.
14.8MarketingCarriermeansthecarrierwhosetwolettersairlinedesignatorcodeisrecordedasthetransportingcarrierontheticketflightcoupons.
14.9OperatingCarriermeansthecarrierthatperformsrelevantcarriagebyvirtueofauthorityfromtheContractingCarrier.TheOperatingCarriermaybedifferentfromtheMarketingCarrierinsituationswherecertainbilateralagreementsexist,e.g.codeshareagreement.
14.10CSNSalesAgentmeansapassengersalesagentwhohasbeenauthorizedbyCSNtorepresentCSNinthesalesofairpassengertransportationanditsrelevantservices.
14.11Passenger(s)meansanyperson,exceptmembersofthecrew,carriedortobecarriedinanaircraftwiththeconsentofCSNonthebasisoftheticket.
14.12Childmeansapersonwhohasreachedhis/hersecondbirthdaybutnothis/her12thbirthdayasofthedateofcommencementoftravel.
14.13UnaccompaniedMinormeansapersonwhohasreachedhis/her5thbirthdaybutnothis/her12thbirthdayasofthedateofcommencementoftravelandnotaccompaniedbyparent(s)oranypassengerover18yearsoldwithfullcapacityforcivilconductaswellastheabilitytoescortinthesameclassofservice.
14.14Infantmeansapersonwhohasbeenborn14daysbuthasnotreachedhis/hersecondbirthdayasofthedateofcommencementoftravel.
14.15YearsOldmeansthecalculationbasedontheyear,monthanddayoftheGregoriancalendar,startingfromthefirstbirthday.
14.16Reservationmeansthereservationofseatandclassofserviceortheweightandsizeofbaggageappointedbypassenger.
14.17Flightmeanstheflyingofaircraftaccordingtoscheduledroute,dateandtime.
14.18ConnectingFlightmeanstwoormoreflightslistedinasinglecontractofcarriage.
14.19CodeShareFlightmeansacarrierorseveralcarriersusetheirownairlinedesignatorcoderespectivelyonanothercarrier’soperatingflightinaccordancewiththeiragreement.
14.20Ticketmeansatypeoftransportationcertificate,includingpaperticketandelectronicticket..
14.21ConjunctionTicketmeansaticketissuedtoapassengerinconjunctionwithanotherticketwhichtogetherconstituteasinglecontractofcarriage.
14.22FixedTicketmeansaticketwhoseflightnumberanddateofflightarefixed,andtheseatisreserved.
14.23OpenTicketmeansaticketwhoseflightnumberanddateofflightarenotfixed,andtheseatisnotreserved.
14.24FlightCouponmeansthatportionoftheticketidentifiedasbeing‘goodforcarriage’andforElectronicTickets,theElectronicCouponthatindicatestheparticularplacesbetweenwhichpassengersareentitledtobecarried.
14.25Daymeanscalendardays,includingallsevendaysoftheweek.Providedthat,forthepurposeofnotification,thedayuponwhichnoticeisdispatchedshallnotbecounted;andprovidedfurtherthatforthepurposesofdeterminingdurationofvalidity,thedayuponwhichtheticketisissued,orthedayuponwhichflightcommenced,shallnotbecounted.
14.26Itinerary/ReceiptofE-TicketforAirTransportationmeansthespecialpaymentproofprovidedbypublicairtransportenterpriseandairsalesagentstopassengerswhenpurchasingtickets.Passengersshallpreserveitwellincaseofrefunds,butitisnotvalidforairportsecuritycheckandboarding.
14.27NormalFaremeansthehighestfareestablishedforaFirst/Business/PremiumEconomy/EconomyClassofvalidadultfare.Children’sfareandinfants’farethatareestablishedasapercentageofanormalfarearealsoconsideredtobenormalfares.
14.28SpecialFaremeansanyfareotherthananormalfare.
14.29ConditionsfortheUseofAirTicketmeanstherulesgoverningfares,applicabletobookingclasscodesorfaretypes.
14.30ClassofServicemeanstheclassificationofaircraftcabinconfigurations,includingFirstClass,BusinessClass,PremiumEconomyClass,andEconomyClass.
14.31BookingclassorReservationsBookingDesignatormeanstheclasscodesshownonthetickets.
14.32ChangeofTicketsorTicketChangemeansthechangeofflightdate,thechangeofbookingclass,endorsetoanotherflight,etc.
14.33RevalidationofTicketsmeansthechangetotheflightschedulesanddatesindicatedontheairticketofthesamecarrier.
14.34Endorsementmeansthechangeofmarketingcarrier.
14.35ChangeFeemeansachargeforpassenger’svoluntaryrequestofchangingtheiroriginalflightreservation.
14.36RefundFeemeansachargeforpassenger’svoluntaryrequestofrefund.

14.38AgreedTransitionPointmeansapointinanitinerary,otherthantheoriginanddestination,atwhichascheduledtransitistobemade.
14.39Stopoverpointmeansthatwiththepriorconsentofthecarrier,apassengermakesanintentionalarrangementtodiscontinuehis/herjourneyatacertainpointwhentravelingbetweenthepointoforiginandthepointofdestination.
14.40Overbookingmeansthatacarriersellsmoreseatsthantheactualnumberofseatsavailableonaflightinordertoavoidemptyseats.
14.41DeadlineTimeforCheck-inmeansthelatesttimestipulatedforpassengerbyoperatingcarriertofinishthecheck-informalities.
14.42MissaFlightmeansapassengerfailstoboardaflightspecifiedinhis/herticketbecausethepassengerfailstocompletecheck-inproceduresbeforestipulatedcheck-indeadlineorthepassengerpresentsatraveldocumentthatnon-compliantwithrelevantrequirements.
14.43FailtoBoardaFlightmeansapassengerfailstoboardaflightspecifiedinhis/herticketafterhavingcompletedthecheck-inproceduresorwhileduringtransit.
14.44BoardaWrongFlightmeansapassengertakesaflightotherthantheonespecifiedonhis/herticket.
14.45Baggagemeansreferstothepersonalarticlesofpassengerscarriedinthecourseofitinerarybyagreementwiththecarrierincludingcheckedbaggageanduncheckedbaggage.
14.46CheckedBaggagemeansthebaggageofwhichCSNtakessolecustodyandforwhichCSNhasissuedabaggagetag.
14.47UncheckedBaggagemeansthebaggagetakencareofbythepassengerhimself/herself.
14.48BaggageCheckmeansthoseportionsoftheticket,whichrelatedtothecarriageofthepassenger’scheckedbaggage.
14.49Damageincludesdeath,injury,delay,loss,partiallossorotherdamageofwhatsoevernaturearisingoutoforinconnectionwithcarriageorotherservicesincidentaltheretoperformedbyCSN.
14.50ForceMajeuremeansanunusualandunforeseeablecircumstancebeyondcontrol,theconsequencesofwhichcouldnothavebeenavoidedevenifallduecarehadbeenexercised.
14.51GratuitousCarriagemeansaircarriagewhichCSNmaycarrypassengerandtheirbaggage(s)byaircraftbutnotreceivingpayment(excludingtaxes,fees,orcharges),includingbutnotlimitedtothegratuitouscarriageduetocourteousreception,marketingpromotion,employee’sdutyorprivatetravelorfrequentflyerprogram.
14.52Chartermeansthecustomizedairplanerequirementsthataredifferentfromordinaryindividualpassengerandgrouptickets,includingbutnotlimitedtoairplanecustomizationandregionalcustomization.
14.53ReasonsAttributabletoCSNmeansthereasonsassociatedwiththeinternalmanagementofthecarrier,includingthoserelatedtoaircraftmaintenance,flightdispatching,crewdeployment,etc.
14.54ReasonsNotAttributabletoCSNmeansotherreasonshavingnottodowiththeinternalmanagementofthecarrier,includingthoserelatedtoweather,emergencies,airtrafficcontrol,securitychecks,passengersandotherfactors.
14.55Flightdelayonarrivalmeansthearrivaltimeoftheaircraftarriveatthedestinationgate(i.e.thewheelblockshavebeenplaced)exceeds15minuteslaterthantheflightscheduledarrivaltime.
14.56Flightdelayatdeparturemeanstheactualdeparturetimeoftheaircraftpush-backfromdeparturegate(i.e.thewheelblockshavebeenremoved)exceeds15minuteslaterthantheflightscheduleddeparturetime.
14.57Flightearlydepartureorflightdeparturedearlymeanstothesituationwherethescheduledflightdeparturetimeisearlierthanthescheduledflightdeparturetimeshownontheticket.
15.1Effectiveness
TheseConditionsshallcomeintoforceandapplyfrom16May2024,meanwhileTheGeneralConditionsofDomesticCarriageforPassengersandBaggageofChinaSouthernAirlinesCompanyLimitedissuedon15March2024isabolished.
15.2Modification
15.2.1CSNmaymodifytheseConditionswithoutnoticeaccordingtotheprocedureofCAAC.Thismodificationwillnotapplytothepassengerswhohavepurchasedticketsbeforesuchmodification.
15.2.2Noagent,employeeorrepresentativeofCSNhasauthoritytovary,modifyorwaiveanyprovisionoftheseConditions.
