HAVERESOLVEDTOCOMBINEOUREFFORTSTOACCOMPLISHTHESEAIMS
Accordingly,ourrespectiveGovernments,throughrepresentativesassembledinthecityofSanFrancisco,whohaveexhibitedtheirfullpowersfoundtobeingoodanddueform,haveagreedtothepresentCharteroftheUnitedNationsanddoherebyestablishaninternationalorganizationtobeknownastheUnitedNations.
CHAPTERI:PURPOSESANDPRINCIPLES
Article1
ThePurposesoftheUnitedNationsare:
Tomaintaininternationalpeaceandsecurity,andtothatend:totakeeffectivecollectivemeasuresforthepreventionandremovalofthreatstothepeace,andforthesuppressionofactsofaggressionorotherbreachesofthepeace,andtobringaboutbypeacefulmeans,andinconformitywiththeprinciplesofjusticeandinternationallaw,adjustmentorsettlementofinternationaldisputesorsituationswhichmightleadtoabreachofthepeace;
Todevelopfriendlyrelationsamongnationsbasedonrespectfortheprincipleofequalrightsandself-determinationofpeoples,andtotakeotherappropriatemeasurestostrengthenuniversalpeace;
Toachieveinternationalco-operationinsolvinginternationalproblemsofaneconomic,social,cultural,orhumanitariancharacter,andinpromotingandencouragingrespectforhumanrightsandforfundamentalfreedomsforallwithoutdistinctionastorace,sex,language,orreligion;and
Tobeacentreforharmonizingtheactionsofnationsintheattainmentofthesecommonends.
Article2
TheOrganizationanditsMembers,inpursuitofthePurposesstatedinArticle1,shallactinaccordancewiththefollowingPrinciples.
TheOrganizationisbasedontheprincipleofthesovereignequalityofallitsMembers.
AllMembers,inordertoensuretoallofthemtherightsandbenefitsresultingfrommembership,shallfulfillingoodfaiththeobligationsassumedbytheminaccordancewiththepresentCharter.
AllMembersshallsettletheirinternationaldisputesbypeacefulmeansinsuchamannerthatinternationalpeaceandsecurity,andjustice,arenotendangered.
AllMembersshallrefrainintheirinternationalrelationsfromthethreatoruseofforceagainsttheterritorialintegrityorpoliticalindependenceofanystate,orinanyothermannerinconsistentwiththePurposesoftheUnitedNations.
AllMembersshallgivetheUnitedNationseveryassistanceinanyactionittakesinaccordancewiththepresentCharter,andshallrefrainfromgivingassistancetoanystateagainstwhichtheUnitedNationsistakingpreventiveorenforcementaction.
TheOrganizationshallensurethatstateswhicharenotMembersoftheUnitedNationsactinaccordancewiththesePrinciplessofarasmaybenecessaryforthemaintenanceofinternationalpeaceandsecurity.
NothingcontainedinthepresentChartershallauthorizetheUnitedNationstointerveneinmatterswhichareessentiallywithinthedomesticjurisdictionofanystateorshallrequiretheMemberstosubmitsuchmatterstosettlementunderthepresentCharter;butthisprincipleshallnotprejudicetheapplicationofenforcementmeasuresunderChapterVll.
CHAPTERII:MEMBERSHIP
Article3
TheoriginalMembersoftheUnitedNationsshallbethestateswhich,havingparticipatedintheUnitedNationsConferenceonInternationalOrganizationatSanFrancisco,orhavingpreviouslysignedtheDeclarationbyUnitedNationsof1January1942,signthepresentCharterandratifyitinaccordancewithArticle110.
Article4
MembershipintheUnitedNationsisopentoallotherpeace-lovingstateswhichaccepttheobligationscontainedinthepresentCharterand,inthejudgmentoftheOrganization,areableandwillingtocarryouttheseobligations.
TheadmissionofanysuchstatetomembershipintheUnitedNationswillbeeffectedbyadecisionoftheGeneralAssemblyupontherecommendationoftheSecurityCouncil.
Article5
AMemberoftheUnitedNationsagainstwhichpreventiveorenforcementactionhasbeentakenbytheSecurityCouncilmaybesuspendedfromtheexerciseoftherightsandprivilegesofmembershipbytheGeneralAssemblyupontherecommendationoftheSecurityCouncil.TheexerciseoftheserightsandprivilegesmayberestoredbytheSecurityCouncil.
Article6
AMemberoftheUnitedNationswhichhaspersistentlyviolatedthePrinciplescontainedinthepresentChartermaybeexpelledfromtheOrganizationbytheGeneralAssemblyupontherecommendationoftheSecurityCouncil.
CHAPTERIII:ORGANS
Article7
ThereareestablishedasprincipalorgansoftheUnitedNations:aGeneralAssembly,aSecurityCouncil,anEconomicandSocialCouncil,aTrusteeshipCouncil,anInternationalCourtofJusticeandaSecretariat.
SuchsubsidiaryorgansasmaybefoundnecessarymaybeestablishedinaccordancewiththepresentCharter.
Article8
TheUnitedNationsshallplacenorestrictionsontheeligibilityofmenandwomentoparticipateinanycapacityandunderconditionsofequalityinitsprincipalandsubsidiaryorgans.
CHAPTERIV:THEGENERALASSEMBLY
COMPOSITION
Article9
TheGeneralAssemblyshallconsistofalltheMembersoftheUnitedNations.
EachMembershallhavenotmorethanfiverepresentativesintheGeneralAssembly.
FUNCTIONSandPOWERS
Article10
TheGeneralAssemblymaydiscussanyquestionsoranymatterswithinthescopeofthepresentCharterorrelatingtothepowersandfunctionsofanyorgansprovidedforinthepresentCharter,and,exceptasprovidedinArticle12,maymakerecommendationstotheMembersoftheUnitedNationsortotheSecurityCouncilortobothonanysuchquestionsormatters.
Article11
TheGeneralAssemblymayconsiderthegeneralprinciplesofco-operationinthemaintenanceofinternationalpeaceandsecurity,includingtheprinciplesgoverningdisarmamentandtheregulationofarmaments,andmaymakerecommendationswithregardtosuchprinciplestotheMembersortotheSecurityCouncilortoboth.
TheGeneralAssemblymaydiscussanyquestionsrelatingtothemaintenanceofinternationalpeaceandsecuritybroughtbeforeitbyanyMemberoftheUnitedNations,orbytheSecurityCouncil,orbyastatewhichisnotaMemberoftheUnitedNationsinaccordancewithArticle35,paragraph2,and,exceptasprovidedinArticle12,maymakerecommendationswithregardtoanysuchquestionstothestateorstatesconcernedortotheSecurityCouncilortoboth.AnysuchquestiononwhichactionisnecessaryshallbereferredtotheSecurityCouncilbytheGeneralAssemblyeitherbeforeorafterdiscussion.
TheGeneralAssemblymaycalltheattentionoftheSecurityCounciltosituationswhicharelikelytoendangerinternationalpeaceandsecurity.
ThepowersoftheGeneralAssemblysetforthinthisArticleshallnotlimitthegeneralscopeofArticle10.
Article12
WhiletheSecurityCouncilisexercisinginrespectofanydisputeorsituationthefunctionsassignedtoitinthepresentCharter,theGeneralAssemblyshallnotmakeanyrecommendationwithregardtothatdisputeorsituationunlesstheSecurityCouncilsorequests.
TheSecretary-General,withtheconsentoftheSecurityCouncil,shallnotifytheGeneralAssemblyateachsessionofanymattersrelativetothemaintenanceofinternationalpeaceandsecuritywhicharebeingdealtwithbytheSecurityCouncilandshallsimilarlynotifytheGeneralAssembly,ortheMembersoftheUnitedNationsiftheGeneralAssemblyisnotinsession,immediatelytheSecurityCouncilceasestodealwithsuchmatters.
Article13
TheGeneralAssemblyshallinitiatestudiesandmakerecommendationsforthepurposeof:
promotinginternationalco-operationinthepoliticalfieldandencouragingtheprogressivedevelopmentofinternationallawanditscodification;
promotinginternationalco-operationintheeconomic,social,cultural,educational,andhealthfields,andassistingintherealizationofhumanrightsandfundamentalfreedomsforallwithoutdistinctionastorace,sex,language,orreligion.
Thefurtherresponsibilities,functionsandpowersoftheGeneralAssemblywithrespecttomattersmentionedinparagraph1(b)abovearesetforthinChaptersIXandX.
Article14
SubjecttotheprovisionsofArticle12,theGeneralAssemblymayrecommendmeasuresforthepeacefuladjustmentofanysituation,regardlessoforigin,whichitdeemslikelytoimpairthegeneralwelfareorfriendlyrelationsamongnations,includingsituationsresultingfromaviolationoftheprovisionsofthepresentChartersettingforththePurposesandPrinciplesoftheUnitedNations.
Article15
TheGeneralAssemblyshallreceiveandconsiderannualandspecialreportsfromtheSecurityCouncil;thesereportsshallincludeanaccountofthemeasuresthattheSecurityCouncilhasdecideduponortakentomaintaininternationalpeaceandsecurity.
TheGeneralAssemblyshallreceiveandconsiderreportsfromtheotherorgansoftheUnitedNations.
Article16
TheGeneralAssemblyshallperformsuchfunctionswithrespecttotheinternationaltrusteeshipsystemasareassignedtoitunderChaptersXIIandXIII,includingtheapprovalofthetrusteeshipagreementsforareasnotdesignatedasstrategic.
Article17
TheGeneralAssemblyshallconsiderandapprovethebudgetoftheOrganization.
TheexpensesoftheOrganizationshallbebornebytheMembersasapportionedbytheGeneralAssembly.
TheGeneralAssemblyshallconsiderandapproveanyfinancialandbudgetaryarrangementswithspecializedagenciesreferredtoinArticle57andshallexaminetheadministrativebudgetsofsuchspecializedagencieswithaviewtomakingrecommendationstotheagenciesconcerned.
VOTING
Article18
EachmemberoftheGeneralAssemblyshallhaveonevote.
DecisionsoftheGeneralAssemblyonimportantquestionsshallbemadebyatwo-thirdsmajorityofthememberspresentandvoting.Thesequestionsshallinclude:recommendationswithrespecttothemaintenanceofinternationalpeaceandsecurity,theelectionofthenon-permanentmembersoftheSecurityCouncil,theelectionofthemembersoftheEconomicandSocialCouncil,theelectionofmembersoftheTrusteeshipCouncilinaccordancewithparagraph1(c)ofArticle86,theadmissionofnewMemberstotheUnitedNations,thesuspensionoftherightsandprivilegesofmembership,theexpulsionofMembers,questionsrelatingtotheoperationofthetrusteeshipsystem,andbudgetaryquestions.
Decisionsonotherquestions,includingthedeterminationofadditionalcategoriesofquestionstobedecidedbyatwo-thirdsmajority,shallbemadebyamajorityofthememberspresentandvoting.
Article19
AMemberoftheUnitedNationswhichisinarrearsinthepaymentofitsfinancialcontributionstotheOrganizationshallhavenovoteintheGeneralAssemblyiftheamountofitsarrearsequalsorexceedstheamountofthecontributionsduefromitfortheprecedingtwofullyears.TheGeneralAssemblymay,nevertheless,permitsuchaMembertovoteifitissatisfiedthatthefailuretopayisduetoconditionsbeyondthecontroloftheMember.
PROCEDURE
Article20
TheGeneralAssemblyshallmeetinregularannualsessionsandinsuchspecialsessionsasoccasionmayrequire.SpecialsessionsshallbeconvokedbytheSecretary-GeneralattherequestoftheSecurityCouncilorofamajorityoftheMembersoftheUnitedNations.
Article21
TheGeneralAssemblyshalladoptitsownrulesofprocedure.ItshallelectitsPresidentforeachsession.
Article22
TheGeneralAssemblymayestablishsuchsubsidiaryorgansasitdeemsnecessaryfortheperformanceofitsfunctions.
CHAPTERV:THESECURITYCOUNCIL
Article23
TheSecurityCouncilshallconsistoffifteenMembersoftheUnitedNations.TheRepublicofChina,France,theUnionofSovietSocialistRepublics,theUnitedKingdomofGreatBritainandNorthernIreland,andtheUnitedStatesofAmericashallbepermanentmembersoftheSecurityCouncil.TheGeneralAssemblyshallelecttenotherMembersoftheUnitedNationstobenon-permanentmembersoftheSecurityCouncil,dueregardbeingspeciallypaid,inthefirstinstancetothecontributionofMembersoftheUnitedNationstothemaintenanceofinternationalpeaceandsecurityandtotheotherpurposesoftheOrganization,andalsotoequitablegeographicaldistribution.
Thenon-permanentmembersoftheSecurityCouncilshallbeelectedforatermoftwoyears.Inthefirstelectionofthenon-permanentmembersaftertheincreaseofthemembershipoftheSecurityCouncilfromeleventofifteen,twoofthefouradditionalmembersshallbechosenforatermofoneyear.Aretiringmembershallnotbeeligibleforimmediatere-election.
EachmemberoftheSecurityCouncilshallhaveonerepresentative.
Article24
InordertoensurepromptandeffectiveactionbytheUnitedNations,itsMembersconferontheSecurityCouncilprimaryresponsibilityforthemaintenanceofinternationalpeaceandsecurity,andagreethatincarryingoutitsdutiesunderthisresponsibilitytheSecurityCouncilactsontheirbehalf.
IndischargingthesedutiestheSecurityCouncilshallactinaccordancewiththePurposesandPrinciplesoftheUnitedNations.ThespecificpowersgrantedtotheSecurityCouncilforthedischargeofthesedutiesarelaiddowninChaptersVI,VII,VIII,andXII.
TheSecurityCouncilshallsubmitannualand,whennecessary,specialreportstotheGeneralAssemblyforitsconsideration.
Article25
TheMembersoftheUnitedNationsagreetoacceptandcarryoutthedecisionsoftheSecurityCouncilinaccordancewiththepresentCharter.
Article26
Inordertopromotetheestablishmentandmaintenanceofinternationalpeaceandsecuritywiththeleastdiversionforarmamentsoftheworld'shumanandeconomicresources,theSecurityCouncilshallberesponsibleforformulating,withtheassistanceoftheMilitaryStaffCommitteereferredtoinArticle47,planstobesubmittedtotheMembersoftheUnitedNationsfortheestablishmentofasystemfortheregulationofarmaments.
Article27
EachmemberoftheSecurityCouncilshallhaveonevote.
DecisionsoftheSecurityCouncilonproceduralmattersshallbemadebyanaffirmativevoteofninemembers.
DecisionsoftheSecurityCouncilonallothermattersshallbemadebyanaffirmativevoteofninemembersincludingtheconcurringvotesofthepermanentmembers;providedthat,indecisionsunderChapterVI,andunderparagraph3ofArticle52,apartytoadisputeshallabstainfromvoting.
Article28
TheSecurityCouncilshallbesoorganizedastobeabletofunctioncontinuously.EachmemberoftheSecurityCouncilshallforthispurposeberepresentedatalltimesattheseatoftheOrganization.
TheSecurityCouncilshallholdperiodicmeetingsatwhicheachofitsmembersmay,ifitsodesires,berepresentedbyamemberofthegovernmentorbysomeotherspeciallydesignatedrepresentative.
TheSecurityCouncilmayholdmeetingsatsuchplacesotherthantheseatoftheOrganizationasinitsjudgmentwillbestfacilitateitswork.
Article29
TheSecurityCouncilmayestablishsuchsubsidiaryorgansasitdeemsnecessaryfortheperformanceofitsfunctions.
Article30
TheSecurityCouncilshalladoptitsownrulesofprocedure,includingthemethodofselectingitsPresident.
Article31
AnyMemberoftheUnitedNationswhichisnotamemberoftheSecurityCouncilmayparticipate,withoutvote,inthediscussionofanyquestionbroughtbeforetheSecurityCouncilwheneverthelatterconsidersthattheinterestsofthatMemberarespeciallyaffected.
Article32
AnyMemberoftheUnitedNationswhichisnotamemberoftheSecurityCounciloranystatewhichisnotaMemberoftheUnitedNations,ifitisapartytoadisputeunderconsiderationbytheSecurityCouncil,shallbeinvitedtoparticipate,withoutvote,inthediscussionrelatingtothedispute.TheSecurityCouncilshalllaydownsuchconditionsasitdeemsjustfortheparticipationofastatewhichisnotaMemberoftheUnitedNations.
CHAPTERVI:PACIFICSETTLEMENTOFDISPUTES
Article33
Thepartiestoanydispute,thecontinuanceofwhichislikelytoendangerthemaintenanceofinternationalpeaceandsecurity,shall,firstofall,seekasolutionbynegotiation,enquiry,mediation,conciliation,arbitration,judicialsettlement,resorttoregionalagenciesorarrangements,orotherpeacefulmeansoftheirownchoice.
TheSecurityCouncilshall,whenitdeemsnecessary,calluponthepartiestosettletheirdisputebysuchmeans.
Article34
TheSecurityCouncilmayinvestigateanydispute,oranysituationwhichmightleadtointernationalfrictionorgiverisetoadispute,inordertodeterminewhetherthecontinuanceofthedisputeorsituationislikelytoendangerthemaintenanceofinternationalpeaceandsecurity.
Article35
AnyMemberoftheUnitedNationsmaybringanydispute,oranysituationofthenaturereferredtoinArticle34,totheattentionoftheSecurityCounciloroftheGeneralAssembly.
AstatewhichisnotaMemberoftheUnitedNationsmaybringtotheattentionoftheSecurityCounciloroftheGeneralAssemblyanydisputetowhichitisapartyifitacceptsinadvance,forthepurposesofthedispute,theobligationsofpacificsettlementprovidedinthepresentCharter.
TheproceedingsoftheGeneralAssemblyinrespectofmattersbroughttoitsattentionunderthisArticlewillbesubjecttotheprovisionsofArticles11and12.
Article36
TheSecurityCouncilmay,atanystageofadisputeofthenaturereferredtoinArticle33orofasituationoflikenature,recommendappropriateproceduresormethodsofadjustment.
TheSecurityCouncilshouldtakeintoconsiderationanyproceduresforthesettlementofthedisputewhichhavealreadybeenadoptedbytheparties.
InmakingrecommendationsunderthisArticletheSecurityCouncilshouldalsotakeintoconsiderationthatlegaldisputesshouldasageneralrulebereferredbythepartiestotheInternationalCourtofJusticeinaccordancewiththeprovisionsoftheStatuteoftheCourt.
Article37
ShouldthepartiestoadisputeofthenaturereferredtoinArticle33failtosettleitbythemeansindicatedinthatArticle,theyshallreferittotheSecurityCouncil.
IftheSecurityCouncildeemsthatthecontinuanceofthedisputeisinfactlikelytoendangerthemaintenanceofinternationalpeaceandsecurity,itshalldecidewhethertotakeactionunderArticle36ortorecommendsuchtermsofsettlementasitmayconsiderappropriate.
Article38
WithoutprejudicetotheprovisionsofArticles33to37,theSecurityCouncilmay,ifallthepartiestoanydisputesorequest,makerecommendationstothepartieswithaviewtoapacificsettlementofthedispute.
CHAPTERVII:ACTIONWITHRESPECTTOTHREATSTOTHEPEACE,BREACHESOFTHEPEACE,ANDACTSOFAGGRESSION
Article39
TheSecurityCouncilshalldeterminetheexistenceofanythreattothepeace,breachofthepeace,oractofaggressionandshallmakerecommendations,ordecidewhatmeasuresshallbetakeninaccordancewithArticles41and42,tomaintainorrestoreinternationalpeaceandsecurity.
Article40
Inordertopreventanaggravationofthesituation,theSecurityCouncilmay,beforemakingtherecommendationsordecidinguponthemeasuresprovidedforinArticle39,calluponthepartiesconcernedtocomplywithsuchprovisionalmeasuresasitdeemsnecessaryordesirable.Suchprovisionalmeasuresshallbewithoutprejudicetotherights,claims,orpositionofthepartiesconcerned.TheSecurityCouncilshalldulytakeaccountoffailuretocomplywithsuchprovisionalmeasures.
Article41
TheSecurityCouncilmaydecidewhatmeasuresnotinvolvingtheuseofarmedforcearetobeemployedtogiveeffecttoitsdecisions,anditmaycallupontheMembersoftheUnitedNationstoapplysuchmeasures.Thesemayincludecompleteorpartialinterruptionofeconomicrelationsandofrail,sea,air,postal,telegraphic,radio,andothermeansofcommunication,andtheseveranceofdiplomaticrelations.
Article42
ShouldtheSecurityCouncilconsiderthatmeasuresprovidedforinArticle41wouldbeinadequateorhaveprovedtobeinadequate,itmaytakesuchactionbyair,sea,orlandforcesasmaybenecessarytomaintainorrestoreinternationalpeaceandsecurity.Suchactionmayincludedemonstrations,blockade,andotheroperationsbyair,sea,orlandforcesofMembersoftheUnitedNations.
Article43
AllMembersoftheUnitedNations,inordertocontributetothemaintenanceofinternationalpeaceandsecurity,undertaketomakeavailabletotheSecurityCouncil,onitscallandinaccordancewithaspecialagreementoragreements,armedforces,assistance,andfacilities,includingrightsofpassage,necessaryforthepurposeofmaintaininginternationalpeaceandsecurity.
Suchagreementoragreementsshallgovernthenumbersandtypesofforces,theirdegreeofreadinessandgenerallocation,andthenatureofthefacilitiesandassistancetobeprovided.
TheagreementoragreementsshallbenegotiatedassoonaspossibleontheinitiativeoftheSecurityCouncil.TheyshallbeconcludedbetweentheSecurityCouncilandMembersorbetweentheSecurityCouncilandgroupsofMembersandshallbesubjecttoratificationbythesignatorystatesinaccordancewiththeirrespectiveconstitutionalprocesses.
Article44
WhentheSecurityCouncilhasdecidedtouseforceitshall,beforecallinguponaMembernotrepresentedonittoprovidearmedforcesinfulfilmentoftheobligationsassumedunderArticle43,invitethatMember,iftheMembersodesires,toparticipateinthedecisionsoftheSecurityCouncilconcerningtheemploymentofcontingentsofthatMember'sarmedforces.
Article45
InordertoenabletheUnitedNationstotakeurgentmilitarymeasures,Membersshallholdimmediatelyavailablenationalair-forcecontingentsforcombinedinternationalenforcementaction.ThestrengthanddegreeofreadinessofthesecontingentsandplansfortheircombinedactionshallbedeterminedwithinthelimitslaiddowninthespecialagreementoragreementsreferredtoinArticle43,bytheSecurityCouncilwiththeassistanceoftheMilitaryStaffCommittee.
Article46
PlansfortheapplicationofarmedforceshallbemadebytheSecurityCouncilwiththeassistanceoftheMilitaryStaffCommittee.
Article47
ThereshallbeestablishedaMilitaryStaffCommitteetoadviseandassisttheSecurityCouncilonallquestionsrelatingtotheSecurityCouncil'smilitaryrequirementsforthemaintenanceofinternationalpeaceandsecurity,theemploymentandcommandofforcesplacedatitsdisposal,theregulationofarmaments,andpossibledisarmament.
TheMilitaryStaffCommitteeshallconsistoftheChiefsofStaffofthepermanentmembersoftheSecurityCouncilortheirrepresentatives.AnyMemberoftheUnitedNationsnotpermanentlyrepresentedontheCommitteeshallbeinvitedbytheCommitteetobeassociatedwithitwhentheefficientdischargeoftheCommittee'sresponsibilitiesrequirestheparticipationofthatMemberinitswork.
TheMilitaryStaffCommitteeshallberesponsibleundertheSecurityCouncilforthestrategicdirectionofanyarmedforcesplacedatthedisposaloftheSecurityCouncil.Questionsrelatingtothecommandofsuchforcesshallbeworkedoutsubsequently.

TheactionrequiredtocarryoutthedecisionsoftheSecurityCouncilforthemaintenanceofinternationalpeaceandsecurityshallbetakenbyalltheMembersoftheUnitedNationsorbysomeofthem,astheSecurityCouncilmaydetermine.
SuchdecisionsshallbecarriedoutbytheMembersoftheUnitedNationsdirectlyandthroughtheiractionintheappropriateinternationalagenciesofwhichtheyaremembers.
Article49
TheMembersoftheUnitedNationsshalljoininaffordingmutualassistanceincarryingoutthemeasuresdecideduponbytheSecurityCouncil.
Article50
IfpreventiveorenforcementmeasuresagainstanystatearetakenbytheSecurityCouncil,anyotherstate,whetheraMemberoftheUnitedNationsornot,whichfindsitselfconfrontedwithspecialeconomicproblemsarisingfromthecarryingoutofthosemeasuresshallhavetherighttoconsulttheSecurityCouncilwithregardtoasolutionofthoseproblems.
Article51
NothinginthepresentChartershallimpairtheinherentrightofindividualorcollectiveself-defenceifanarmedattackoccursagainstaMemberoftheUnitedNations,untiltheSecurityCouncilhastakenmeasuresnecessarytomaintaininternationalpeaceandsecurity.MeasurestakenbyMembersintheexerciseofthisrightofself-defenceshallbeimmediatelyreportedtotheSecurityCouncilandshallnotinanywayaffecttheauthorityandresponsibilityoftheSecurityCouncilunderthepresentChartertotakeatanytimesuchactionasitdeemsnecessaryinordertomaintainorrestoreinternationalpeaceandsecurity.
CHAPTERVIII:REGIONALARRANGEMENTS
Article52
NothinginthepresentCharterprecludestheexistenceofregionalarrangementsoragenciesfordealingwithsuchmattersrelatingtothemaintenanceofinternationalpeaceandsecurityasareappropriateforregionalactionprovidedthatsucharrangementsoragenciesandtheiractivitiesareconsistentwiththePurposesandPrinciplesoftheUnitedNations.
TheMembersoftheUnitedNationsenteringintosucharrangementsorconstitutingsuchagenciesshallmakeeveryefforttoachievepacificsettlementoflocaldisputesthroughsuchregionalarrangementsorbysuchregionalagenciesbeforereferringthemtotheSecurityCouncil.
TheSecurityCouncilshallencouragethedevelopmentofpacificsettlementoflocaldisputesthroughsuchregionalarrangementsorbysuchregionalagencieseitherontheinitiativeofthestatesconcernedorbyreferencefromtheSecurityCouncil.
ThisArticleinnowayimpairstheapplicationofArticles34and35.
Article53
TheSecurityCouncilshall,whereappropriate,utilizesuchregionalarrangementsoragenciesforenforcementactionunderitsauthority.ButnoenforcementactionshallbetakenunderregionalarrangementsorbyregionalagencieswithouttheauthorizationoftheSecurityCouncil,withtheexceptionofmeasuresagainstanyenemystate,asdefinedinparagraph2ofthisArticle,providedforpursuanttoArticle107orinregionalarrangementsdirectedagainstrenewalofaggressivepolicyonthepartofanysuchstate,untilsuchtimeastheOrganizationmay,onrequestoftheGovernmentsconcerned,bechargedwiththeresponsibilityforpreventingfurtheraggressionbysuchastate.
Thetermenemystateasusedinparagraph1ofthisArticleappliestoanystatewhichduringtheSecondWorldWarhasbeenanenemyofanysignatoryofthepresentCharter.

TheSecurityCouncilshallatalltimesbekeptfullyinformedofactivitiesundertakenorincontemplationunderregionalarrangementsorbyregionalagenciesforthemaintenanceofinternationalpeaceandsecurity.
CHAPTERIX:INTERNATIONALECONOMICANDSOCIALCO-OPERATION

Withaviewtothecreationofconditionsofstabilityandwell-beingwhicharenecessaryforpeacefulandfriendlyrelationsamongnationsbasedonrespectfortheprincipleofequalrightsandself-determinationofpeoples,theUnitedNationsshallpromote:
a.higherstandardsofliving,fullemployment,andconditionsofeconomicandsocialprogressanddevelopment;
b.solutionsofinternationaleconomic,social,health,andrelatedproblems;andinternationalculturalandeducationalcooperation;and
c.universalrespectfor,andobservanceof,humanrightsandfundamentalfreedomsforallwithoutdistinctionastorace,sex,language,orreligion.

AllMemberspledgethemselvestotakejointandseparateactioninco-operationwiththeOrganizationfortheachievementofthepurposessetforthinArticle55.
Article57
Thevariousspecializedagencies,establishedbyintergovernmentalagreementandhavingwideinternationalresponsibilities,asdefinedintheirbasicinstruments,ineconomic,social,cultural,educational,health,andrelatedfields,shallbebroughtintorelationshipwiththeUnitedNationsinaccordancewiththeprovisionsofArticle63.
SuchagenciesthusbroughtintorelationshipwiththeUnitedNationsarehereinafterreferredtoasspecializedagencies.
Article58
TheOrganizationshallmakerecommendationsfortheco-ordinationofthepoliciesandactivitiesofthespecializedagencies.

TheOrganizationshall,whereappropriate,initiatenegotiationsamongthestatesconcernedforthecreationofanynewspecializedagenciesrequiredfortheaccomplishmentofthepurposessetforthinArticle55.

ResponsibilityforthedischargeofthefunctionsoftheOrganizationsetforthinthisChaptershallbevestedintheGeneralAssemblyand,undertheauthorityoftheGeneralAssembly,intheEconomicandSocialCouncil,whichshallhaveforthispurposethepowerssetforthinChapterX.
CHAPTERX:THEECONOMICANDSOCIALCOUNCIL

TheEconomicandSocialCouncilshallconsistoffifty-fourMembersoftheUnitedNationselectedbytheGeneralAssembly.
Subjecttotheprovisionsofparagraph3,eighteenmembersoftheEconomicandSocialCouncilshallbeelectedeachyearforatermofthreeyears.Aretiringmembershallbeeligibleforimmediatere-election.
AtthefirstelectionaftertheincreaseinthemembershipoftheEconomicandSocialCouncilfromtwenty-seventofifty-fourmembers,inadditiontothememberselectedinplaceoftheninememberswhosetermofofficeexpiresattheendofthatyear,twenty-sevenadditionalmembersshallbeelected.Ofthesetwenty-sevenadditionalmembers,thetermofofficeofninememberssoelectedshallexpireattheendofoneyear,andofnineothermembersattheendoftwoyears,inaccordancewitharrangementsmadebytheGeneralAssembly.
EachmemberoftheEconomicandSocialCouncilshallhaveonerepresentative.

TheEconomicandSocialCouncilmaymakeorinitiatestudiesandreportswithrespecttointernationaleconomic,social,cultural,educational,health,andrelatedmattersandmaymakerecommendationswithrespecttoanysuchmatterstotheGeneralAssemblytotheMembersoftheUnitedNations,andtothespecializedagenciesconcerned.
Itmaymakerecommendationsforthepurposeofpromotingrespectfor,andobservanceof,humanrightsandfundamentalfreedomsforall.
ItmaypreparedraftconventionsforsubmissiontotheGeneralAssembly,withrespecttomattersfallingwithinitscompetence.
Itmaycall,inaccordancewiththerulesprescribedbytheUnitedNations,internationalconferencesonmattersfallingwithinitscompetence.
Article63
TheEconomicandSocialCouncilmayenterintoagreementswithanyoftheagenciesreferredtoinArticle57,definingthetermsonwhichtheagencyconcernedshallbebroughtintorelationshipwiththeUnitedNations.SuchagreementsshallbesubjecttoapprovalbytheGeneralAssembly.
Itmayco-ordinatetheactivitiesofthespecializedagenciesthroughconsultationwithandrecommendationstosuchagenciesandthroughrecommendationstotheGeneralAssemblyandtotheMembersoftheUnitedNations.
Article64
TheEconomicandSocialCouncilmaytakeappropriatestepstoobtainregularreportsfromthespecializedagencies.ItmaymakearrangementswiththeMembersoftheUnitedNationsandwiththespecializedagenciestoobtainreportsonthestepstakentogiveeffecttoitsownrecommendationsandtorecommendationsonmattersfallingwithinitscompetencemadebytheGeneralAssembly.
ItmaycommunicateitsobservationsonthesereportstotheGeneralAssembly.
Article65
TheEconomicandSocialCouncilmayfurnishinformationtotheSecurityCouncilandshallassisttheSecurityCounciluponitsrequest.
Article66
TheEconomicandSocialCouncilshallperformsuchfunctionsasfallwithinitscompetenceinconnectionwiththecarryingoutoftherecommendationsoftheGeneralAssembly.
Itmay,withtheapprovaloftheGeneralAssembly,performservicesattherequestofMembersoftheUnitedNationsandattherequestofspecializedagencies.
ItshallperformsuchotherfunctionsasarespecifiedelsewhereinthepresentCharterorasmaybeassignedtoitbytheGeneralAssembly.
Article67
EachmemberoftheEconomicandSocialCouncilshallhaveonevote.
DecisionsoftheEconomicandSocialCouncilshallbemadebyamajorityofthememberspresentandvoting.
Article68
TheEconomicandSocialCouncilshallsetupcommissionsineconomicandsocialfieldsandforthepromotionofhumanrights,andsuchothercommissionsasmayberequiredfortheperformanceofitsfunctions.
Article69
TheEconomicandSocialCouncilshallinviteanyMemberoftheUnitedNationstoparticipate,withoutvote,initsdeliberationsonanymatterofparticularconcerntothatMember.
Article70
TheEconomicandSocialCouncilmaymakearrangementsforrepresentativesofthespecializedagenciestoparticipate,withoutvote,initsdeliberationsandinthoseofthecommissionsestablishedbyit,andforitsrepresentativestoparticipateinthedeliberationsofthespecializedagencies.
Article71
TheEconomicandSocialCouncilmaymakesuitablearrangementsforconsultationwithnon-governmentalorganizationswhichareconcernedwithmatterswithinitscompetence.Sucharrangementsmaybemadewithinternationalorganizationsand,whereappropriate,withnationalorganizationsafterconsultationwiththeMemberoftheUnitedNationsconcerned.
Article72
TheEconomicandSocialCouncilshalladoptitsownrulesofprocedure,includingthemethodofselectingitsPresident.
TheEconomicandSocialCouncilshallmeetasrequiredinaccordancewithitsrules,whichshallincludeprovisionfortheconveningofmeetingsontherequestofamajorityofitsmembers.
CHAPTERXI:DECLARATIONREGARDINGNON-SELF-GOVERNINGTERRITORIES

MembersoftheUnitedNationswhichhaveorassumeresponsibilitiesfortheadministrationofterritorieswhosepeopleshavenotyetattainedafullmeasureofself-governmentrecognizetheprinciplethattheinterestsoftheinhabitantsoftheseterritoriesareparamount,andacceptasasacredtrusttheobligationtopromotetotheutmost,withinthesystemofinternationalpeaceandsecurityestablishedbythepresentCharter,thewell-beingoftheinhabitantsoftheseterritories,and,tothisend:
a.toensure,withduerespectforthecultureofthepeoplesconcerned,theirpolitical,economic,social,andeducationaladvancement,theirjusttreatment,andtheirprotectionagainstabuses;
b.todevelopself-government,totakedueaccountofthepoliticalaspirationsofthepeoples,andtoassistthemintheprogressivedevelopmentoftheirfreepoliticalinstitutions,accordingtotheparticularcircumstancesofeachterritoryanditspeoplesandtheirvaryingstagesofadvancement;
c.tofurtherinternationalpeaceandsecurity;
d.topromoteconstructivemeasuresofdevelopment,toencourageresearch,andtoco-operatewithoneanotherand,whenandwhereappropriate,withspecializedinternationalbodieswithaviewtothepracticalachievementofthesocial,economic,andscientificpurposessetforthinthisArticle;and
e.totransmitregularlytotheSecretary-Generalforinformationpurposes,subjecttosuchlimitationassecurityandconstitutionalconsiderationsmayrequire,statisticalandotherinformationofatechnicalnaturerelatingtoeconomic,social,andeducationalconditionsintheterritoriesforwhichtheyarerespectivelyresponsibleotherthanthoseterritoriestowhichChaptersXIIandXIIIapply.

MembersoftheUnitedNationsalsoagreethattheirpolicyinrespectoftheterritoriestowhichthisChapterapplies,nolessthaninrespectoftheirmetropolitanareas,mustbebasedonthegeneralprincipleofgood-neighbourliness,dueaccountbeingtakenoftheinterestsandwell-beingoftherestoftheworld,insocial,economic,andcommercialmatters.
CHAPTERXII:INTERNATIONALTRUSTEESHIPSYSTEM
Article75
TheUnitedNationsshallestablishunderitsauthorityaninternationaltrusteeshipsystemfortheadministrationandsupervisionofsuchterritoriesasmaybeplacedthereunderbysubsequentindividualagreements.Theseterritoriesarehereinafterreferredtoastrustterritories.
Article76
Thebasicobjectivesofthetrusteeshipsystem,inaccordancewiththePurposesoftheUnitedNationslaiddowninArticle1ofthepresentCharter,shallbe:
a.tofurtherinternationalpeaceandsecurity;
b.topromotethepolitical,economic,social,andeducationaladvancementoftheinhabitantsofthetrustterritories,andtheirprogressivedevelopmenttowardsself-governmentorindependenceasmaybeappropriatetotheparticularcircumstancesofeachterritoryanditspeoplesandthefreelyexpressedwishesofthepeoplesconcerned,andasmaybeprovidedbythetermsofeachtrusteeshipagreement;
c.toencouragerespectforhumanrightsandforfundamentalfreedomsforallwithoutdistinctionastorace,sex,language,orreligion,andtoencouragerecognitionoftheinterdependenceofthepeoplesoftheworld;and
d.toensureequaltreatmentinsocial,economic,andcommercialmattersforallMembersoftheUnitedNationsandtheirnationals,andalsoequaltreatmentforthelatterintheadministrationofjustice,withoutprejudicetotheattainmentoftheforegoingobjectivesandsubjecttotheprovisionsofArticle80.
Article77
1Thetrusteeshipsystemshallapplytosuchterritoriesinthefollowingcategoriesasmaybeplacedthereunderbymeansoftrusteeshipagreements:
a.territoriesnowheldundermandate;
b.territorieswhichmaybedetachedfromenemystatesasaresultoftheSecondWorldWar;and
c.territoriesvoluntarilyplacedunderthesystembystatesresponsiblefortheiradministration.
2Itwillbeamatterforsubsequentagreementastowhichterritoriesintheforegoingcategorieswillbebroughtunderthetrusteeshipsystemanduponwhatterms.
Article78
ThetrusteeshipsystemshallnotapplytoterritorieswhichhavebecomeMembersoftheUnitedNations,relationshipamongwhichshallbebasedonrespectfortheprincipleofsovereignequality.
Article79
Thetermsoftrusteeshipforeachterritorytobeplacedunderthetrusteeshipsystem,includinganyalterationoramendment,shallbeagreeduponbythestatesdirectlyconcerned,includingthemandatorypowerinthecaseofterritoriesheldundermandatebyaMemberoftheUnitedNations,andshallbeapprovedasprovidedforinArticles83and85.
Article80
Exceptasmaybeagreeduponinindividualtrusteeshipagreements,madeunderArticles77,79,and81,placingeachterritoryunderthetrusteeshipsystem,anduntilsuchagreementshavebeenconcluded,nothinginthisChaptershallbeconstruedinorofitselftoalterinanymannertherightswhatsoeverofanystatesoranypeoplesorthetermsofexistinginternationalinstrumentstowhichMembersoftheUnitedNationsmayrespectivelybeparties.
Paragraph1ofthisArticleshallnotbeinterpretedasgivinggroundsfordelayorpostponementofthenegotiationandconclusionofagreementsforplacingmandatedandotherterritoriesunderthetrusteeshipsystemasprovidedforinArticle77.
Article81
Thetrusteeshipagreementshallineachcaseincludethetermsunderwhichthetrustterritorywillbeadministeredanddesignatetheauthoritywhichwillexercisetheadministrationofthetrustterritory.Suchauthority,hereinaftercalledtheadministeringauthority,maybeoneormorestatesortheOrganizationitself.
Article82
Theremaybedesignated,inanytrusteeshipagreement,astrategicareaorareaswhichmayincludepartorallofthetrustterritorytowhichtheagreementapplies,withoutprejudicetoanyspecialagreementoragreementsmadeunderArticle43.
Article83
AllfunctionsoftheUnitedNationsrelatingtostrategicareas,includingtheapprovalofthetermsofthetrusteeshipagreementsandoftheiralterationoramendmentshallbeexercisedbytheSecurityCouncil.
ThebasicobjectivessetforthinArticle76shallbeapplicabletothepeopleofeachstrategicarea.
TheSecurityCouncilshall,subjecttotheprovisionsofthetrusteeshipagreementsandwithoutprejudicetosecurityconsiderations,availitselfoftheassistanceoftheTrusteeshipCounciltoperformthosefunctionsoftheUnitedNationsunderthetrusteeshipsystemrelatingtopolitical,economic,social,andeducationalmattersinthestrategicareas.
Article84
Itshallbethedutyoftheadministeringauthoritytoensurethatthetrustterritoryshallplayitspartinthemaintenanceofinternationalpeaceandsecurity.Tothisendtheadministeringauthoritymaymakeuseofvolunteerforces,facilities,andassistancefromthetrustterritoryincarryingouttheobligationstowardstheSecurityCouncilundertakeninthisregardbytheadministeringauthority,aswellasforlocaldefenceandthemaintenanceoflawandorderwithinthetrustterritory.
Article85
ThefunctionsoftheUnitedNationswithregardtotrusteeshipagreementsforallareasnotdesignatedasstrategic,includingtheapprovalofthetermsofthetrusteeshipagreementsandoftheiralterationoramendment,shallbeexercisedbytheGeneralAssembly.
TheTrusteeshipCouncil,operatingundertheauthorityoftheGeneralAssemblyshallassisttheGeneralAssemblyincarryingoutthesefunctions.
CHAPTERXIII:THETRUSTEESHIPCOUNCIL
Article86
1TheTrusteeshipCouncilshallconsistofthefollowingMembersoftheUnitedNations:
a.thoseMembersadministeringtrustterritories;
b.suchofthoseMembersmentionedbynameinArticle23asarenotadministeringtrustterritories;and
c.asmanyotherMemberselectedforthree-yeartermsbytheGeneralAssemblyasmaybenecessarytoensurethatthetotalnumberofmembersoftheTrusteeshipCouncilisequallydividedbetweenthoseMembersoftheUnitedNationswhichadministertrustterritoriesandthosewhichdonot.
2EachmemberoftheTrusteeshipCouncilshalldesignateonespeciallyqualifiedpersontorepresentittherein.
Article87
TheGeneralAssemblyand,underitsauthority,theTrusteeshipCouncil,incarryingouttheirfunctions,may:
a.considerreportssubmittedbytheadministeringauthority;
b.acceptpetitionsandexaminetheminconsultationwiththeadministeringauthority;
c.provideforperiodicvisitstotherespectivetrustterritoriesattimesagreeduponwiththeadministeringauthority;and
d.taketheseandotheractionsinconformitywiththetermsofthetrusteeshipagreements.
Article88
TheTrusteeshipCouncilshallformulateaquestionnaireonthepolitical,economic,social,andeducationaladvancementoftheinhabitantsofeachtrustterritory,andtheadministeringauthorityforeachtrustterritorywithinthecompetenceoftheGeneralAssemblyshallmakeanannualreporttotheGeneralAssemblyuponthebasisofsuchquestionnaire.
Article89
EachmemberoftheTrusteeshipCouncilshallhaveonevote.
DecisionsoftheTrusteeshipCouncilshallbemadebyamajorityofthememberspresentandvoting.
Article90
TheTrusteeshipCouncilshalladoptitsownrulesofprocedure,includingthemethodofselectingitsPresident.
TheTrusteeshipCouncilshallmeetasrequiredinaccordancewithitsrules,whichshallincludeprovisionfortheconveningofmeetingsontherequestofamajorityofitsmembers.

TheTrusteeshipCouncilshall,whenappropriate,availitselfoftheassistanceoftheEconomicandSocialCouncilandofthespecializedagenciesinregardtomatterswithwhichtheyarerespectivelyconcerned.
CHAPTERXIV:THEINTERNATIONALCOURTOFJUSTICE
Article92
TheInternationalCourtofJusticeshallbetheprincipaljudicialorganoftheUnitedNations.ItshallfunctioninaccordancewiththeannexedStatute,whichisbasedupontheStatuteofthePermanentCourtofInternationalJusticeandformsanintegralpartofthepresentCharter.
Article93
AllMembersoftheUnitedNationsareipsofactopartiestotheStatuteoftheInternationalCourtofJustice.
AstatewhichisnotaMemberoftheUnitedNationsmaybecomeapartytotheStatuteoftheInternationalCourtofJusticeonconditionstobedeterminedineachcasebytheGeneralAssemblyupontherecommendationoftheSecurityCouncil.
Article94
EachMemberoftheUnitedNationsundertakestocomplywiththedecisionoftheInternationalCourtofJusticeinanycasetowhichitisaparty.
IfanypartytoacasefailstoperformtheobligationsincumbentuponitunderajudgmentrenderedbytheCourt,theotherpartymayhaverecoursetotheSecurityCouncil,whichmay,ifitdeemsnecessary,makerecommendationsordecideuponmeasurestobetakentogiveeffecttothejudgment.

NothinginthepresentChartershallpreventMembersoftheUnitedNationsfromentrustingthesolutionoftheirdifferencestoothertribunalsbyvirtueofagreementsalreadyinexistenceorwhichmaybeconcludedinthefuture.

a.TheGeneralAssemblyortheSecurityCouncilmayrequesttheInternationalCourtofJusticetogiveanadvisoryopiniononanylegalquestion.
b.OtherorgansoftheUnitedNationsandspecializedagencies,whichmayatanytimebesoauthorizedbytheGeneralAssembly,mayalsorequestadvisoryopinionsoftheCourtonlegalquestionsarisingwithinthescopeoftheiractivities.
CHAPTERXV:THESECRETARIAT

TheSecretariatshallcompriseaSecretary-GeneralandsuchstaffastheOrganizationmayrequire.TheSecretary-GeneralshallbeappointedbytheGeneralAssemblyupontherecommendationoftheSecurityCouncil.HeshallbethechiefadministrativeofficeroftheOrganization.

TheSecretary-GeneralshallactinthatcapacityinallmeetingsoftheGeneralAssembly,oftheSecurityCouncil,oftheEconomicandSocialCouncil,andoftheTrusteeshipCouncil,andshallperformsuchotherfunctionsasareentrustedtohimbytheseorgans.TheSecretary-GeneralshallmakeanannualreporttotheGeneralAssemblyontheworkoftheOrganization.

TheSecretary-GeneralmaybringtotheattentionoftheSecurityCouncilanymatterwhichinhisopinionmaythreatenthemaintenanceofinternationalpeaceandsecurity.
Article100
IntheperformanceoftheirdutiestheSecretary-GeneralandthestaffshallnotseekorreceiveinstructionsfromanygovernmentorfromanyotherauthorityexternaltotheOrganization.TheyshallrefrainfromanyactionwhichmightreflectontheirpositionasinternationalofficialsresponsibleonlytotheOrganization.
EachMemberoftheUnitedNationsundertakestorespecttheexclusivelyinternationalcharacteroftheresponsibilitiesoftheSecretary-Generalandthestaffandnottoseektoinfluencetheminthedischargeoftheirresponsibilities.
Article101
ThestaffshallbeappointedbytheSecretary-GeneralunderregulationsestablishedbytheGeneralAssembly.
AppropriatestaffsshallbepermanentlyassignedtotheEconomicandSocialCouncil,theTrusteeshipCouncil,and,asrequired,tootherorgansoftheUnitedNations.ThesestaffsshallformapartoftheSecretariat.
Theparamountconsiderationintheemploymentofthestaffandinthedeterminationoftheconditionsofserviceshallbethenecessityofsecuringthehigheststandardsofefficiency,competence,andintegrity.Dueregardshallbepaidtotheimportanceofrecruitingthestaffonaswideageographicalbasisaspossible.
CHAPTERXVI:MISCELLANEOUSPROVISIONS

EverytreatyandeveryinternationalagreemententeredintobyanyMemberoftheUnitedNationsafterthepresentChartercomesintoforceshallassoonaspossibleberegisteredwiththeSecretariatandpublishedbyit.
Nopartytoanysuchtreatyorinternationalagreementwhichhasnotbeenregisteredinaccordancewiththeprovisionsofparagraph1ofthisArticlemayinvokethattreatyoragreementbeforeanyorganoftheUnitedNations.
Article103
IntheeventofaconflictbetweentheobligationsoftheMembersoftheUnitedNationsunderthepresentCharterandtheirobligationsunderanyotherinternationalagreement,theirobligationsunderthepresentChartershallprevail.
Article104
TheOrganizationshallenjoyintheterritoryofeachofitsMemberssuchlegalcapacityasmaybenecessaryfortheexerciseofitsfunctionsandthefulfilmentofitspurposes.
Article105
TheOrganizationshallenjoyintheterritoryofeachofitsMemberssuchprivilegesandimmunitiesasarenecessaryforthefulfilmentofitspurposes.
RepresentativesoftheMembersoftheUnitedNationsandofficialsoftheOrganizationshallsimilarlyenjoysuchprivilegesandimmunitiesasarenecessaryfortheindependentexerciseoftheirfunctionsinconnexionwiththeOrganization.
TheGeneralAssemblymaymakerecommendationswithaviewtodeterminingthedetailsoftheapplicationofparagraphs1and2ofthisArticleormayproposeconventionstotheMembersoftheUnitedNationsforthispurpose.
CHAPTERXVII:TRANSITIONALSECURITYARRANGEMENTS
Article106
PendingthecomingintoforceofsuchspecialagreementsreferredtoinArticle43asintheopinionoftheSecurityCouncilenableittobegintheexerciseofitsresponsibilitiesunderArticle42,thepartiestotheFour-NationDeclaration,signedatMoscow,30October1943,andFrance,shall,inaccordancewiththeprovisionsofparagraph5ofthatDeclaration,consultwithoneanotherandasoccasionrequireswithotherMembersoftheUnitedNationswithaviewtosuchjointactiononbehalfoftheOrganizationasmaybenecessaryforthepurposeofmaintaininginternationalpeaceandsecurity.
Article107
NothinginthepresentChartershallinvalidateorprecludeaction,inrelationtoanystatewhichduringtheSecondWorldWarhasbeenanenemyofanysignatorytothepresentCharter,takenorauthorizedasaresultofthatwarbytheGovernmentshavingresponsibilityforsuchaction.
CHAPTERXVIII:AMENDMENTS
Article108
AmendmentstothepresentChartershallcomeintoforceforallMembersoftheUnitedNationswhentheyhavebeenadoptedbyavoteoftwothirdsofthemembersoftheGeneralAssemblyandratifiedinaccordancewiththeirrespectiveconstitutionalprocessesbytwothirdsoftheMembersoftheUnitedNations,includingallthepermanentmembersoftheSecurityCouncil.
Article109
AGeneralConferenceoftheMembersoftheUnitedNationsforthepurposeofreviewingthepresentChartermaybeheldatadateandplacetobefixedbyatwo-thirdsvoteofthemembersoftheGeneralAssemblyandbyavoteofanyninemembersoftheSecurityCouncil.EachMemberoftheUnitedNationsshallhaveonevoteintheconference.
AnyalterationofthepresentCharterrecommendedbyatwo-thirdsvoteoftheconferenceshalltakeeffectwhenratifiedinaccordancewiththeirrespectiveconstitutionalprocessesbytwothirdsoftheMembersoftheUnitedNationsincludingallthepermanentmembersoftheSecurityCouncil.
IfsuchaconferencehasnotbeenheldbeforethetenthannualsessionoftheGeneralAssemblyfollowingthecomingintoforceofthepresentCharter,theproposaltocallsuchaconferenceshallbeplacedontheagendaofthatsessionoftheGeneralAssembly,andtheconferenceshallbeheldifsodecidedbyamajorityvoteofthemembersoftheGeneralAssemblyandbyavoteofanysevenmembersoftheSecurityCouncil.
CHAPTERXIX:RATIFICATIONANDSIGNATURE
Article110
ThepresentChartershallberatifiedbythesignatorystatesinaccordancewiththeirrespectiveconstitutionalprocesses.
TheratificationsshallbedepositedwiththeGovernmentoftheUnitedStatesofAmerica,whichshallnotifyallthesignatorystatesofeachdepositaswellastheSecretary-GeneraloftheOrganizationwhenhehasbeenappointed.
ThepresentChartershallcomeintoforceuponthedepositofratificationsbytheRepublicofChina,France,theUnionofSovietSocialistRepublics,theUnitedKingdomofGreatBritainandNorthernIreland,andtheUnitedStatesofAmerica,andbyamajorityoftheothersignatorystates.AprotocoloftheratificationsdepositedshallthereuponbedrawnupbytheGovernmentoftheUnitedStatesofAmericawhichshallcommunicatecopiesthereoftoallthesignatorystates.
ThestatessignatorytothepresentCharterwhichratifyitafterithascomeintoforcewillbecomeoriginalMembersoftheUnitedNationsonthedateofthedepositoftheirrespectiveratifications.
Article111
ThepresentCharter,ofwhichtheChinese,French,Russian,English,andSpanishtextsareequallyauthentic,shallremaindepositedinthearchivesoftheGovernmentoftheUnitedStatesofAmerica.DulycertifiedcopiesthereofshallbetransmittedbythatGovernmenttotheGovernmentsoftheothersignatorystates.
INFAITHWHEREOFtherepresentativesoftheGovernmentsoftheUnitedNationshavesignedthepresentCharter.DONEatthecityofSanFranciscothetwenty-sixthdayofJune,onethousandninehundredandforty-five.
